Resolution No. 2344RESOLUTION NO. 2344 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 81 -4 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an Application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to construct an administrative office and warehousing for Panasonic Corporation at 6550 Katella Avenue. 2. That the City Council, after proper notice thereof, duly held a public hearing on said Application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is that: This zone is intended as an area for modern industrial/ commercial development which meets the high performance and development standards of the City. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) An extensive environmental review resulted in the filing of a Negative Declaration since the project produces minimal traffic volumes and will simply be the storage of electronic hardware. Therefore, there should not be any adverse impacts upon the environment resulting from this project. (2) Administrative office and warehouse land uses are allowable land uses in accordance with the BP- 20,000 Business Park Zone and the General Plan Land Use designation for the subject property. (3) The subject land use will comply with the development criteria established in the corporate center master plan under review by the Cypress City Council. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. 4. The City Council DOES HEREBY GRANT said conditional use permit, subject to the conditions attached hereto as Exhibit "A." The final exterior color scheme shall be submitted to City staff for review and approval prior to actually painting the structure. 2. Specific details shall be submitted to City staff for review and approval concerning the actual method of screening all roof top mechanical equip- ment. Said screening shall be completed prior to building occupancy. 3. A comprehensive sign program for both building and freestanding monument signs shall be submitted for Planning Department approval prior to any signing installation. 4. A landscape and irrigation plan shall be reviewed and approved by City staff prior to any installation of landscaping on the property. In addition to a fully automatic irrigation system, a landscape maintenance bond shall be posted with the Public Works Department to guarantee against defects in materials and workmanship of the landscape installation and the maintenance thereof for a period of one year from landscape installation. 5. The remaining dirt area designated for future building expansion shall he treated in one of the following manners: a Seeded with temporary turf to eliminate blowing dust and the growth of unsightly weeds. b. Leased for agricultural purposes. 6 The business hours of operation in relation to truck dock activity shall be limited from 7 a.m. to 6 p.m. only, on Monday through Saturday. Late night or early morning deliveries shall be specifically prohibited. 7. In accordance with Parcel Map No. 80 -1160 and this conditional use permit, a 35 foot wide by 8 foot high landscaped earth berm buffer shall be constructed along the southerly property line pursuant to the master landscaped berm plan as approved by the Cypress City Council. The landscaped berm shall he constructed and completely landscaped prior to occupancy of Phase One. 8. The fire sprinkler water storage tank and pump building shall be screened from adjoining property view. The method of screening shall be reviewed and approved by City staff prior to occupancy. 9. Outside public address speakers, telephone bells, buzzers and similar devices which are audible on adjoining properties are hereby prohibited. All exterior mechanical equipment, such as air conditioning compressors. shall be adequately screened from adjoining property view and insulated so that they are not audible beyond the subject property lines. - 2 10. Exterior security lighting shall not glare upon adjoining residential properties to the south. 11. All requirements of the Orange County Fire Marshal's Office shall be satisfied prior to occupancy of the subject building. 12. All product and material storage shall occur within the building. Exterior storage is specifically prohibited. 13. Driveways along Katella Avenue, Dana Way, Darin Way and holder Street shall be constructed to a minimum of 30 feet wide. 14. Katella Avenue shall be improved with sidewalk along the south side of the right -of -way from Holder Street to Dana Way. The extension of Darin Way shall be fully improved with curb, gutter, driveway and street pavement. Said street shall be offered for dedication but shall not be accepted by the City at this time. This extension of Darin Way shall be maintained by the property owners' association. 15. "No parking or stopping any time" signs shall be installed along Katella Avenue in front of this development. 16. The developer of this project shall provide adequate on -site speed control within the development to the satisfaction of the City Engineer. 17. Future building construction known as Phase Two will be subject to Design Review Committee approval for final building architecture and site plan configuration. 18. All applicable conditions of Parcel Map No. 80 -1160 shall be complied with prior to occupancy of the subject building. 19. The specific warehouse distribution and office land use shall comply with all applicable provisions of the City Municipal Code.
