Resolution No. 407593 RESOLUTION NO. 4075 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CONDITIONAL USE PERMIT NO. 92 -5 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to establish a 1,000 square foot onsite retail dry cleaners to include the use of garment cleaning and finishing equipment located within the Meridian Plaza at 10953 Meridian Drive, in the PC -1 Planned Community Industrial /Commercial Zone 1. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended to encourage the establishment of compatible industries in areas where it is deemed desirable to provide for limited manufacturing facilities and to establish standards of design and type of use which will enhance the area, be in harmony with the objectives of the General Plan and minimize detrimental effects to the public health, safety and welfare; to designate an area for modern industrial and research developments and commercial uses that can meet high performance and development standards, while benefiting the community through growth, prosperity and providing an increasing supply of citizen employment and services; and to allow diversification of specified land uses as they relate to each other in a physical and environmental arrangement, while ensuring substantial compliance with the overall goals of the City as identified in the various elements of the General Plan. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The proposed location of Conditional Use Permit No. 92 -5 is in accord with the objectives of the Commercial Ordinance regulating the operation of an onsite dry cleaners and the purpose of the PC -1 Planned Community Industrial /Commercial Zone 1. (2) The proposed location of the conditional use and the conditions imposed as part of this approval assure the operation and maintenance of this use will not be detrimental to the public health, safety, and welfare, or materially injurious to properties or improvements in the vicinity because such use requires South Coast Air Quality Management District (SCAQMD) permit approval in conjunction with City approval. (3) The proposed conditional use permit complies with the General Plan and each of the applicable provisions of the Commercial Ordinance and SCAQMD requirements in that the proper permits have been obtained in order operate an onsite dry cleaners. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Conditional Use Permit No. 92 -5, subject to the conditions attached hereto as Exhibit "A." The developer shall conform to all applicable provisions of the City Code. 2. The applicant shall obtain a Cypress business license prior to commencement of the business operation. 3. Utilities shall not be released until all conditions of approval have been met to the satisfaction of the Planning Department. 4. The applicant shall not erect or display on the subject property any signs which have not been approved in writing by the Planning Department. 5. All roof mounted equipment, such as heating and air conditioning units, shall be adequately screened from public view subject to the approval of City staff. 6. All product and material storage shall occur within the building. Exterior storage is specifically prohibited. 7. The inclusion of additional dry cleaning machines shall require an amendment to Conditional Use Permit No. 92 -5. 8. Applicant shall comply with the provisions of the City of Cypress Noise Ordinance. 9. The City reserves the right to review the hours of operation should substantiated complaints be received. 10. Applicant /developer shall comply with applicable provisions of the 1988 Uniform Building, Plumbing and Mechanical Codes, 1990 National Electrical Code, California Administrative Code, Title 24, and the Cypress City Code. 11. The applicant /developer is required to submit electrical and plumbing plans to the Building Department for plan check. 12. An automatic fire sprinkler system, approved by the Fire Marshal, may be required. 13. Prior to the issuance of a Certificate of Occupancy, disclose to the Fire Department Hazardous Materials Office the type and quantity of hazardous materials. The disclosure shall be on the Hazardous Material Disclosure form. 14. If there is a boiler with 400,000 BTU or more, there shall be provided a one -hour rated wall and door assembly around the boiler. Exhibit "A" Conditional Use Permit No. 92 -5 Conditions of Approval Page 2 15. The following notes shall be on the plans: a. Fire Department Final Inspection Required. Schedule inspection 2 days in advance. Phone (714) 821 -7850. b. Locations and classifications of extinguishers to be determined by fire Inspector. c. Storage, dispensing or use of any flammable and combustible liquids, flammable and compressed gasses and other hazardous materials shall comply with Uniform Fire Code Regulations. d. Building(s) not approved for high piles combustible storage. Materials in closely packed piles shall not exceed 16 feet in height, 12 feet on pallets, or in racks and 6 feet for tires, plastics and some flammable liquids. If high stock piking, comply with UFC, Art. 81 and NFPA Std. 231, 231C and 231D. e. Plans of modifications to or new fire protection, detector or alarm system(s) shall be approved by the Fire Department prior to installation. Revised 5/11/92
