Resolution No. 408511 RESOLUTION NO. 4085 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS SUPERSEDING RESOLUTION NO. 3708 AND SETTING FORTH THE LOCAL CONDITIONS UPON WHICH A DETERMINATION HAS BEEN MADE BY THE CITY COUNCIL THAT MODIFICATIONS TO THE 1990 EDITION OF THE NATIONAL ELECTRICAL CODE ARE REASONABLY REQUIRED BY LOCAL CONDITIONS WITHIN THE CITY OF CYPRESS. THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, Health and Safety Code Section 17922 requires the City of Cypress to adopt the most current edition of the National Electrical Code; and WHEREAS, Health and Safety Code Section 17958.5 authorizes the City Council to make changes or modifications in the most current edition of the National Electrical Code as may be reasonably necessary because of the existence of certain local conditions; and WHEREAS, the Building Official of the City of Cypress has determined and recommends that, based upon the existence of certain local conditions within the City of Cypress, the modifications to the 1990 edition of the National Electrical Code contained in Ordinance No.888 are reasonably required to be adopted by the City of Cypress; and WHEREAS, Health and Safety Code Section 17958.7 requires the City Council to make express findings of the necessity for modifications in the most current edition of the National Electrical Code. WHEREAS, it is appropriate to describe the existence of specific local conditions upon which each said modification is based. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress that the following amendments and modifications to the 1990 edition of the National Electrical Code contained in Ordinance No. 888 are hereby found to be reasonably necessary due to consideration of specific local climatic, geological, or topographical conditions as follows: 1. Local climatic conditions necessitate that residential dwelling units be protected from construction practices and electricity usage practices that have had a history of causing or contributing to the cause of fire related damage to residential dwelling structures in the City of Cypress. (Affects Sections 110 -5, 210 -1, 215 -10, 220 -3, 230 -43, 336 -3, 350 -2, and 422 -5) 2. Local geological conditions in the City of Cypress, require that grounding electrodes be manufactured of corrosion - resistant material to protect the grounding electrode from deterioration due to high sulfate levels found in the soil. [Affects Section 250- 81(c)] 3. Modifications to Section 90 -4 are administrative amendments of local discretion. BE IT FURTHER RESOLVED that a copy of this Resolution, together with a copy of Ordinance No. 888 adopting the 1990 edition of National Electrical Code, as amended, be filed with the State Department of Housing and Community Development. 117 PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 22nd day of June, 1992.
