RESOLUTION NO. 4135
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, AND ACTING AS
EX- OFFICIO BOARD OF DIRECTORS OF THE CYPRESS RECREATION AND PARK
DISTRICT, A SUBSIDIARY DISTRICT OF THE CITY OF CYPRESS, AMENDING
RESOLUTION NO. 1635 AND RESOLUTION NO. 4041, RULES AND REGULATIONS,
CHAPTER 2, SECTION 2.01, CONCERNING DEFINITIONS, CHAPTER 4, SECTION
4.07, CONCERNING ESTABLISHMENT OF EMPLOYMENT LIST, SECTION 4.08,
CONCERNING KINDS OF EMPLOYMENT LISTS, SECTION 4.09, CONCERNING REMOVAL
OF NAMES FROM EMPLOYMENT LISTS AND SECTION 4.19, CONCERNING LATERAL
ENTRY AND /OR ACADEMY ENTRY FOR EMPLOYEES OF THE CITY OF CYPRESS AND
CYPRESS RECREATION AND PARK DISTRICT.
WHEREAS, the City Council of the City of Cypress, and acting as
ex- officio Board of Directors of the Cypress Recreation and Park
District, is authorized and directed, under the provisions of the
Personnel Ordinance, to adopt and, from time to time, to amend
City /District Rules and Regulations for the administration of the
Personnel System; and,
WHEREAS, The City Council deems it necessary to amend the
Personnel Rules and Regulations affecting City /District employees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Cypress, and acting as ex- officio Board of Directors of the Cypress
Recreation and Park District, that the following Chapters and Sections
of the Personnel Rules and Regulations be amended as follows:
CHAPTER 2. DEFINITION OF TERMS
Section 2.01 Definitions
DELETE 12. Competitive Examination, 24. Open Competitive
Examination and 33. Promotional Examination
ADD Open Competitive Recruitment and Selection Process and
Closed Promotional Recruitment and Selection Process
Open Competitive Recruitment and Selection Process shall mean
that a recruitment is open to all qualified persons, including City
employees and shall include appropriate procedures and examinations,
either assembled or not assembled, in which one or more applicants,
are in competition either with each other or against a criteria
established by the Personnel Officer as a minimum acceptable standard
which applicants and /or candidates must possess in order to
competently perform the duties of the position.
Closed Promotional Recruitment and Selection Process shall mean
that a recruitment is closed to external applicants and applicable to
qualified City employees only and shall include appropriate procedures
and examinations, either assembled or not assembled, in which one or
more City employees, are in competition either with each other or
against a criteria established by the Personnel Officer as a minimum
acceptable standard which applicants and /or candidates must possess in
order to competently perform the duties of a position in a higher
class with a higher rate of pay and more responsible duties.
AMEND 19. Employment List
Employment List shall mean the report of names of all candidates
who have been deemed qualified, through an appropriate recruitment and
selection process as designated by the Personnel Officer, for
employment in a specific position or classification in the competitive
service.
ADD Continuous Employment List
Continuous Employment List shall mean the report of candidate
names accompanied by an eligibility date of 6 months, who have been
deemed qualified, through an appropriate recruitment and selection
process as designated by the Personnel Officer, for employment in the
position of Police Officer (Lateral or Academy Entry).

ADD Continuous Testing
Continuous Testing shall mean that applications for employment
to fill a specific position are accepted without an application
deadline for an appropriate recruitment and selection process as
scheduled, determined and advertised by the Personnel Officer.
ADD Open Until Filled
Open Until Filled shall mean that applications for employment to
fill a specific position will be accepted until candidate
appointment(s) are completed for an appropriate recruitment and
selection process as scheduled, determined and advertised by the
Personnel Officer.
CHAPTER 4. APPLICATIONS, APPLICANTS AND EMPLOYMENT
AMEND Section 4.07. Establishment of Employment List
After completion of an examination, the Personnel Officer shall
prepare, certify, and make available an employment list, consisting of
the names of candidates who qualified in the examination. The
employment list shall then be submitted to the City Council for
information and receipt. Upon certification and for the exception of
recruitments for Police Officer (Lateral and Academy Trained Entry),
Dispatcher I and Dispatcher II classifications, the list shall become
effective and shall remain in effect for twelve (12) months, unless
exhausted sooner, and may be extended prior to expiration date by the
Personnel Officer for an additional 6 month period, but shall not
remain in effect for more than 2 years.
The establishment of an employment list for recruitments
involving the Police Officer (Lateral and Academy Trained)
classification shall be determined to be continuous; and, thereby
referred to as a continuous employment list, shall in addition to an
employment list established for the Dispatcher I and Dispatcher II
classifications, shall upon certification, become effective and remain .
in effect. for a period not to exceed 6 months. The employment list for
the Dispatcher I and Dispatcher II classifications may be extended
prior to the expiration date by the Personnel Officer for an
additional 6 months, but shall not remain in effect for more than one
year. Candidate names on a continuous employment list for the Police
Officer (Lateral and Academy Trained Entry) may not be extended upon
expiration, but candidates will be notified and allowed to re- submit
an application for employment and /or participate in a future
examination process.
Eligible candidates shall be notified of his /her placement on a
certified employment list and the length of time that such list shall
remain in effect.
AMEND Section 4.08 Kinds of Employment Lists
Employment lists shall be of four kinds:
1. Open competitive employment lists, consisting of names of
candidates who have qualified through an open competitive recruitment
and selection process and from which appointments are made.
2. Closed promotional employment lists, consisting of names of
employee candidates who have qualified through a closed promotional
recruitment and selection process and from which appointments are
made.
3. Re- employment lists, consisting of names of employees who
have been laid off. Such employees shall be placed on appropriate re-
employment lists in the order of their competency, from highest to
lowest, and will remain on such list for a period of 2 years, unless
such persons are re- employed sooner.
4. Continuous Employment List, consisting of names of
candidates who have qualified through an appropriate recruitment and

selection process for the classification of Police Officer (Lateral
and Academy Trained Entry), and from which appointments are made.
AMEND Section 4.09 Removal of Names from Employment Lists
The Personnel Officer may remove the name(s) of any eligible
candidate from an employment list for any of the following reasons:
1. Upon written notice from an eligible candidate requesting
removal of his /her name.
2. Upon notice from an eligible candidate declining
appointment.
3. If an eligible candidate fails to respond to a notice of
consideration for employment mailed to his /her last known address or
if other reasonable attempts have been made to contact the candidate.
4. If a report of a background investigation is unsatisfactory.
5. Upon the recommendation of an appointing power and approval
of the Personnel Officer after the eligible candidate has been
considered for employment and his /her employment would not be in the
best interest of the City or as may also apply to Section 4.03,
Disqualification.
6. If less than 3 eligible candidates remain on the employment
list, the appointing power may request that the employment list be
cancelled and a new employment list be established.
7. Upon expiration of a candidate's 6 -month or 12 -month
eligibility or extended eligibility on an employment list and upon
expiration of a candidate's 6 -month eligibility on a continuous
employment list for the position of Police Officer (Lateral and
Academy Trained Entry).
The eligible candidate affected shall be notified of the removal
of his /her name by a notice mailed to his /her last known address,
unless removal is due to #7 above. The names of eligible candidates
on a closed promotional list who resign from the classified service
shall automatically be removed from such list.
AMEND Section 4.19 Lateral Entry and /Or Academy Entry
If in the opinion of the appointing power, a vacancy for the
position of Police Officer could best be filled by recruitment of a
Lateral (experienced) Officer and /or Academy Trained applicant, the
appointing power may then request the Personnel Office to advertise
for such applicants. All such applicants shall be required to
complete the appropriate recruitment and selection process as
administered by the Personnel Officer. All applicants must possess a
valid California P.O.S.T. Basic Certificate as authorized in the Penal
Code Section 13500 -13523 or be eligible at time of appointment,
pending completion of appropriate City experience, to receive a
California P.O.S.T. Basic Certificate, and meet all other
qualifications of the Police Officer class specification of the
Position Classification Plan of the City of Cypress.
Except as otherwise provided, lateral Officers and /or Academy
Trained candidates hired to Police Officer positions shall be subject
to the same rules and regulations as Police Officers with no prior
experience.
Upon meeting all above requirements, candidates may be appointed
to a Police Officer position at any authorized step within the step
range established for the Police Officer position, subject to the
approval of the City Manager.
The recruitment and selection process for a Lateral Officer or
Academy Trained applicant shall, as for all other positions, be
impartial and shall relate to those areas which, in the opinion of the
Personnel Officer, will adequately and fairly provide candidates with

the relative ability, experience and knowledge to meet the operational
needs of the department.
This amendment shall become effective immediately and will be in
effect for employment lists established as of December 21, 1992.
PASSED AND ADOPTED by the City Council of the City of Cypress,
and acting as ex- officio Board of Directors of the Cypress Recreation
and Park District, at a regular meeting held on the 11th day of
January, 1993.
