Resolution No. 4177340 RESOLUTION NO. 4177 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO. C -192 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed to amend a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to add garage doors to existing carports at the La Palma Apartments located at 6452 Orange Avenue, in the RM -20 Residential Multiple - Family Zone.. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the amended conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended as an area for the development of apartments, condominiums, townhouses or other group dwellings with provisions for adequate light, air, open space and landscaped area at maximum densities of twenty (20.0) dwelling units per acre. Only those additional uses are permitted that are complimentary to, and can exist in harmony with, such residential developments. b. The proposed location of the amended conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The project is consistent with the intent of the RM -20 Residential Multiple - Family Zone, in that garage doors will be added to existing carports for an apartment building; and (2) The project will not be detrimental to the public health, safety, and welfare, in that the purpose of the garage doors is to enhance security for residents and improve property aesthetics; and (3) The project will be consistent with all applicable development standards and has been reviewed by the Design Review Committee. c. The proposed amended conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Amendment to Conditional Use Permit No. C -192, subject to the conditions attached hereto as Exhibit "A." C -192 CONDITIONS OF APPROVAL 1. The applicant shall install garage doors subject to all applicable State and local Codes. 2. If substantiated complaints are received, the property owner shall install partition walls between carport spaces to create individual garages. Proposed plans for the partition walls shall be drawn to demonstrate adequate width for individual garages. Plans shall be reviewed and approved by the Police Department, Orange County Fire Department, Planning Department and the Building Official. 3. Prior to installation of the garage doors, the final exterior color scheme for the doors shall be approved by the Planning Director. 4. A center turn lock such as the Holmes CL-1P (which will always latch when closed and requires a key when open) shall be required. Revised 3/22/93
