Resolution No. 3873v - 33
RESOLUTION NO. 3873
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A VARIANCE
FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF CYPRESS TO ALLOW THE
CONSTRUCTION OF A FOUR (4) UNIT APARTMENT BUILDING
VARIANCE NO. 90 -20
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a variance from the terms of the
Zoning Ordinance of the City of Cypress to allow the construction of a four
(4) unit apartment building at 8761 Moody Street located in the RM -20 /FA
Residential Multiple- Family /Farm Animal Overlay Zone.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
(a) The strict or literal enforcement of the zoning regulations
would result in an unnecessary physical hardship since the subject lot
has a legal non - conforming width of 50 feet while the minimum required
lot width for the RM -20 Zone is 100 feet.
(b) The granting of the variance will not constitute a special
privilege due to the deep but narrow configuration of the lot in this
case. Moreover, similar variances have been granted for other property
owners in this zone.
(c) The granting of the variance will not be detrimental to the
public health, safety, and welfare since adequate access and parking
will be provided onsite. Moreover, the developer shall be required to
dedicate twenty feet (20 ") of lot frontage for the future widening of
Moody Street which will improve traffic circulation.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Variance No. 90 -20 subject to the conditions
set forth in Exhibit "A" attached.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
