A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING
AMENDMENT TO CONDITIONAL USE PERMIT NO. 76 -15 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed to amend a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of the
City of Cypress to establish a day care center at Holy Cross Lutheran Church
located at 4321 Cerritos Avenue in the RS -6000, Residential Single - Family
Zone.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the amended conditional use is in
accord with the objectives of the Zoning Ordinance and the purpose of
the zone in which the site is located is:
Intended as an area for single - family, urban residential
development on minimum lot sizes of six thousand (6,000) square
feet and maximum densities of five (5.0) dwelling units per
acre. Only those additional uses are permitted that are
complimentary to, and can exist in harmony with, a residential
neighborhood.
b. The proposed location of the amended conditional use and the
conditions under which it would be operated or maintained will not be
detrimental to the public health, safety or welfare or be materially
injurious to properties or improvements in the vicinity in that:
(1) The proposed location of the conditional use is in
accord with the objectives of this ordinance and the purpose of the
zone in which the site is located since this is an amendment to a
previously approved conditional use permit.
(2) The proposed location of the conditional use and the
conditions under which it would be operated or maintained will not
be detrimental to the public health, safety, or welfare, or
materially injurious to properties or improvements in the vicinity.
(3) The proposed amendment to the conditional use will
comply with each of the applicable provisions of this ordinance
except for approved variances since the proposed use will not
adversely affect the surrounding area.
c. The proposed amended conditional use will comply with each of
the applicable provisions of the Zoning Ordinance except for approved
variances or adjustments.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Amendment to Conditional Use Permit No. 76 -15
subject to the conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 14th day of January, 1991.

AMENDMENT TO CONDITIONAL USE PERMIT NO. 76 -15
CONDITIONS OF APPROVAL
1. The applicant /developer shall comply with all provisions of the City
Code.

2. All applicable conditions of Amendment to Conditional Use Permit No. 76-
15 shall be complied with prior to occupancy of the subject building.
3. The applicant shall obtain a Cypress business license prior to
commencement of the business operation.
4. Any expansion or modification of the approved use beyond what is
approved as part of the amended Conditional Use Permit No. 76 -15 will
require an amendment to the conditional use permit.
5. A play yard improvement plan shall be submitted for City staff approval
indicating precise location of play equipment and installation of
adequate fencing in order to avoid hazards for children.
6. The approval of Amendment to Conditional Use Permit No. 76 -15 allows for
only interior modification of existing structure per approved site plan
and installation of fencing as indicated for play area.
7. Applicant /developer shall comply with applicable provisions of the 1988
Uniform Building, Plumbing and Mechanical Codes, 1987 National
Electrical Code, California Administrative Code, Title 24, and the
Cypress City Code.
8. Applicant shall submit the following documents to verify compliance with
the Uniform Building Code requirements for "I" occupancy:
a. Complete floor plan to include adjacent areas and its usage.
b. Site plan with dimensions.
9. Applicant shall obtain State approval and necessary permits prior to
commencing business.
10. The applicant /developer shall provide toilet facilities for the
children.
11. The proposed project shall comply with all the requirements of Chapter
10 of the Uniform Building Code.
12. This conditional use permit may be modified or revoked by the City
Council should the Council determine that the proposed use or conditions
under which it is being operated or maintained is detrimental to the
public health, safety, or welfare, or materially injurious to properties
or improvements in the vicinity.
