RESOLUTION NO. 6617
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS,
APPROVING REVISED CONDITIONS OF APPROVAL FOR
DESIGN REVIEW COMMITTEE PERMIT NO. 3036 - WITH CONDITIONS
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a Design Review Committee Permit in
accordance with the provisions of Section 4.19.060.D of the Zoning Ordinance of the City.
of Cypress to allow the construction of 67 multi- family residential units on the property
located at 4552 Lincoln Avenue, within the PC Planned Community Zone.
2. That in accordance with Section 4.19.060.E of the Cypress Zoning
Ordinance, the Design Review Committee reviewed and approved this project on June 25,
2015.
3. That in accordance with Section 4.19.060.E.2 of the Cypress Zoning
Ordinance, the decision of the Design Review Committee on this project was reported to
the City Council on July 27, 2015, during a public meeting of the City Council.
4. That on April 24, 2017, the City Council voted to modify conditions of
approval by adding new conditions to address the screening trees along the south and
west property lines of the project site.
5. That in accordance with Section 4.19.060.F of the Cypress Zoning
Ordinance, the effective date of the Design Review Committee's decision to approve this
project shall be the date of acceptance by the City Council, and upon receipt by the
Community Development Department of an agreement to any conditions of approval
signed by the applicant.
6. That the City Council hereby agrees to add the conditions of approval
identified in the May 22, 2017 agenda report to the original conditions approved by the City
Council on July 27, 2015:
a. The proposed location of the project is in accord with the objectives of
the Zoning Ordinance and the purpose and intent of the zone in which the site is located,
which is:
Intended to permit a compatible mix of land uses, planned
commercial developments and business parks, and a variety of
housing styles and densities.
b. The approved project, including the new added conditions of
approval, will not be detrimental to the public health, safety or welfare or be materially
injurious to properties or improvements in the vicinity in that:
(1) The new added conditions are consistent with City Council
direction to increase the height and screening ability of the perimeter
landscape screening.
(2) The new added conditions will ensure that the trees provide an
increased level of screening at time of planting.
(3) The new added conditions ensure compatibility between the
screening trees and onsite infrastructure required for the project.
(4) The developer has agreed to the new added conditions of
approval provided in attachment "A ".

NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the
City of Cypress does hereby approve the new added conditions of approval for Design
Review Committee Permit No. 3036, subject to the conditions identified in Exhibit "A ".
PASSED AND ADOPTED by the City Council of the City gf Cypress at a regular
meeting held on the 22nd day of May 2017.

Additional City Council Conditions
4552 Lincoln Avenue
1. The applicant shall perform all of the following:
a. Prepare and submit to the Director of Community Development a tree -
screening plan that provides minimum 12 -foot high trees with five feet
spacing that provides adequate screening for neighboring residential
properties.
b. Revise and resubmit for approval any grading, drainage, water quality or
engineering plans that need to be changed due to the increased size of
the trees.
c. Distribute the screening plan to the eight adjacent residential property
owners on both the south and west sides of the property.
d. Consult and meet with the property owners regarding the plan as directed
by the Director.
2. The Director may adjust the spacing or size requirements if there are
incompatible site elements such as storm drains, footings or other conflicts.
3. The Building Official will not issue a certificate of occupancy for the buildings until
all the trees are planted and subsequently verified by the Community
Development Department.
I hereby agree to the above new conditions for the 67 -unit apartment project located at
4552 Lincoln Avenue in the City of Cypress. These conditions will be added to the
original conditions approved by the City Council on July 27, 2015 for Design Review
Committee Permit No. 3036,
