A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO. 87 -26 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of the
City of Cypress to convert the existing Cypress Skateway property into a
church, located at 6143 Ball Road.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the conditional use is in accord with
the objectives of the Zoning Ordinance and the purpose of the zone in
which the site is located is:
This zone is intended as an area for the location of retail
and wholesale commercial activities.
b. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be detrimental
to the public health, safety or welfare or be materially injurious to
properties or improvements in the vicinity in that:
(1) A shared parking agreement is required which will ensure
adequate parking for the proposed church.
(2) Since the hours and days of operation are different for
the church from surrounding retail uses, the church is a compatible
use for the subject property and surrounding uses.
(3) Approval of the church will result in interior and
exterior modifications which will upgrade the property.
c. The proposed conditional use will comply with
applicable provisions of the Zoning Ordinance except
variances or adjustments.
4. The City Council DOES HEREBY GRANT said conditional
subject to the conditions attached hereto as Exhibit "A."

CONDITIONAL USE PERMIT NO. 87 -26
CONDITIONS OF APPROVAL
1. The applicant shall comply with all provisions of the City
Code.
2. Prior to the issuance of building permits, the applicant
shall submit for City approval structural, architectural,
electrical, plumbing and mechanical plans. All work must
meet the requirements of the 1985 California Uniform
Building Code, 1984 National Electrical Code and the State
Handicapped and Title 24 Requirements. Existing bathroom
facilities must meet requirements of Appendix C of the 1985
Building Code.
3. This conditional use permit shall not become effective until
the applicant submits for Design Review Committee approval a
proposed parking plan. This plan shall describe how the
applicant intends to meet minimum parking requirements.
Such a plan must include a signed copy of a shared parking
agreement /lease with an adjacent property owner including no
less than a ninety (90) day notice of termination clause.
The proposed parking plan must also include an alternate
plan in case the original parking agreement terminates.
4. Compact parking space aisles shall be denoted as such on the
asphalt as "Compact Only."
5. Parking for the handicapped shall be provided in accordance
with State requirements.
6. For the Phase I development, the six most southeasterly
parking stalls on the site shall be eliminated for a through
driveway aisle.
For the ultimate development, the driveway crossing the
east property line shall have a minimum width of twenty -four
feet (24').
The two most northwesterly parking stalls at the rear of the
building shall be eliminated. All parking stalls shall have
clear, unobstructed back out.
The parking layout at the northwest corner in front of the
building shall be revised to provide for vehicle turnaround
to the satisfaction of the City Engineer.

7. Access driverway, east of church site, shall be posted "No
Parking -Fire Lane" and comply with the Uniform Fire Code
Section 10.207 and proof of access easement for this road to
the north side of the church.
8. The damaged AC pavement on both sides of the PCC swale along
the east property line shall be removed and replaced.
9. All requirements of the Orange County Fire Marshal's Office
shall be complied with prior to a Certificate of Occupancy
being issued.
10. Drainage shall be solved to the satisfaction of the City
Engineer. A grading plan for Phase I and ultimate
development, signed by a registered California civil
engineer and using actual grades from an Orange County
surveyor's benchmark, shall be submitted for approval. For
new construction, in parking areas AC shall have a minimum
slope gradient of two percent (2 %), and concrete shall have
a minimum slope gradient of two - tenths percent (.2 %).
11. All existing public improvements at the development site
which are damaged due to construction, cracked, or otherwise
below standard, shall be removed and replaced to the
satisfaction of the City Engineer. Three street trees shall
be installed per City standards on Ball Road.
12. The developer shall provide an adequate number of trash
enclosures onsite and at a location acceptable to City
staff.
13. The developer shall not erect or display on the subject
property any signs which have not been approved in writing
by the Planning Department.
14. All roof mounted equipment, such as heating and air
conditioning units, shall be adequately screened from public
view subject to the approval of City staff. Commercial or
industrial developments which adjoin residentially zoned
areas shall construct noise bafflers and /or deflectors on
all mechanical equipment mounted outdoors, to the
satisfaction of City staff.
15. A detailed landscape and automatic irrigation plan shall be
submitted to the Planning Department for review and approval
prior to the issuance of the building permit. In addition,
a cash deposit shall be posted with the Public Works
Department to guarantee installation of the landscape and
automatic irrigation plan and against any defects in plant
materials and workmanship, pcior to the issuance of the
building permit.
16. The final exterior color scheme and improvements shall be
submitted to City staff for review and approval prior to
actually painting the structure and constructing
improvements.

17. Utilities shall not be released until all conditions of
approval have been met to the satisfaction of the Planning
Department.
18. Days and hours of operation may be modified by the City
Council, subject to a public hearing, if expansion of the
days and hours of operation cause substantial parking
problems.
19. Preschool or private school operations have not been
approved as part of this conditional use permit and would
require a separate public hearing before the City Council.
