Ordinance No. 1074ORDINANCE NO. 1074 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CYPRESS CALIFORNIA AMENDING TABLE 2 -20 OF SECTION 2.09 OF THE CYPRESS ZONING CODE REGARDING INCREASED PARKING STANDARDS WITHIN THE DI — DENSITY INCENTIVE OVERLAY ZONE. WHEREAS, the City Council of the City of Cypress recognizes that the provision of on site parking is critical to the design and function of any development; and WHEREAS, the City Council of the City of Cypress also recognizes that the absence of adequate on site parking creates otherwise avoidable negative impacts on surrounding properties and uses; and WHEREAS, the City Council of the City of Cypress wishes to maintain and contribute further to the development standards of the community as already established within the Zoning Code; and WHEREAS, the City Council of the City of Cypress desires to amend Table 2 -20 of the Cypress Zoning Ordinance in order to ensure all of the above. NOW, THEREFORE, the City Council of the City of Cypress hereby ordains as follows: Section 1: That Table 2 -20 of Section 2.09 of the Cypress Zoning Code is hereby amended, in part, to read as follows: TABLE 2 -20 DI OVERLAY ZONING DISTRICT PARKING REQUIREMENTS Residential Multi- family dwelling units, including duplexes, condominiums and townhouses (2 or more dwelling units on one site.) Guest parking Bachelor unit: 1 garage space for each dwelling unit One bedroom unit: 1 garage space for each dwelling unit Two bedroom unit: 2 garage spaces for each dwelling unit Three or four bedroom unit: 2 garage spaces for each dwelling unit Five bedroom unit: 2 or 3 garage spaces, but no less than five total spaces per unit, including guest spaces 2 unassigned open spaces for each dwelling unit on site. Section 2. The City Clerk shall certify to the adoption of this Ordinance, and shall cause the same to be posted and published in the manner required by law. Section 3. If any provision(s) of this ordinance or the application thereof to any person or circumstances is held invalid or unconstitutional by any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any other provision or application, and to this end the provisions of this ordinance are declared to be severable. The City Council hereby declares that they would have adopted this ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the 343 fact that any one or more sections, subsections, clauses, phrases, parts or portions thereof be declared invalid or unconstitutional. Section 4. This ordinance shall be effective thirty (30) days following its adoption. FIRST READING at a regular meeting of the City Council of said City held on the 8th day of May, 2006, and finally adopted and order posted at a regular meeting held on the 22nd day May, 2006.
