A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
GRANTING A VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE
OF THE CITY OF CYPRESS TO ALLOW AN EXISTING ROOM ADDITION WITH
FLAT ROOF, ENCROACHMENT INTO REAR YARD SETBACK, AND A BALCONY /PATIO
ABOVE ROOM ADDITION OF SINGLE- FAMILY HOME.
VARIANCE NO. 88 -8
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a variance from the terms of the
Zoning Ordinance of the City of Cypress to allow an existing room addition
with a flat roof and encroachment into the rear yard setback, along with a
balcony /patio above room addition at 6450 Leone Way.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. Strict or literal interpretation and enforcement of the
specified regulations would result in practical difficulty or
unnecessary physical hardship in that the structure is already in
existence.
b. The granting of the variance as conditioned will not constitute
the granting of a special privilege since a similar second -story balcony
exists in the same zone.
c. The granting of the variance will not be detrimental to the
public health, safety, or welfare, or materially injurious to properties
or improvements in the vicinity.
4. The City Council DOES HEREBY GRANT said variance subject to the
following conditions:
a. The applicant shall comply with all requirements of the City
Code except for approved variances.
b. Conversion of the room addition into an enclosed patio shall be
reviewed under design review by the Planning Department prior to
submittal to the Building Department.
c. Any additional changes to the room addition or the patio shall
require a separate design review. Any modifications to the patio
enclosure must comply with Zoning Ordinance standards, thereby reducing
or eliminating the need for a variance.
d. A six -foot (6 ") screening wall shall be constructed on the
west side of the balcony /patio. Building materials shall match the
existing materials.
e. All requirements of the Building Division must be met.
f. The staircase must be modified so that it is located away from
the west property line, subject to review and approval of the Planning
Director.
PASSED AND ADOPTED by the City Council of the City of Cy' -ss at a
regular meeting held on the 9th day of January 1989.
