A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO. 88 -34 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of the
City of Cypress to allow an existing 270 square foot detached structure to be
used as a guest dwelling unit, and to allow the structure to encroach 7 feet
into the rear yard setback and 2.5 feet into the side yard setback at 5321
Yorkshire Drive.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the conditional use is in accord with
the objectives of the Zoning Ordinance and the purpose of the zone
in which the site is located is:
Intended as an area for single - family, urban residential
development on minimum lot sizes of 6,000 square feet and
maximum densities of 5.0 dwelling units per acre. Only those
additional uses are permitted that are complimentary to, and
can exist in harmony with, a residential neighborhood.
b. The proposed location of the conditional use and the conditions
under which it would be operated or maintained will not be
detrimental to the public health, safety or welfare or be materially
injurious to properties or improvements in the vicinity in that:
(1) The proposed project is consistent with the goals and
objectives of the Cypress General Plan and Zoning Ordinance.
(2) The proposed land use and design of the project is
compatible with the surrounding properties.
(3) The proposed project is strictly a guest dwelling to be
used on a temporary basis, by a non - paying guest of the resident
family.
c. The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments.
4. The City Council DOES HEREBY GRANT said conditional use permit
subject to the following conditions:
a. The applicant shall comply with all requirements of the City
Code except for approved variances.
b. The guest dwelling unit to the rear of the single - family
residence shall be used on a temporary basis, by a non - paying guest of
the resident family. Renting of the guest dwelling is prohibited.
c. If parking becomes a problem or substantiated complaints are
received, the conditional use permit, after a public hearing, shall be
modified to add additional conditions or terminated.

regular meeting held on the 9th day of January 189.
