A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
GRANTING A VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE
OF THE CITY OF CYPRESS TO ALLOW AN EXISTING DETACHED STRUCTURE
TO BE USED AS A GUEST DWELLING UNIT, AND TO ALLOW THE STRUCTURE
TO ENCROACH INTO THE REAR YARD AND SIDE YARD SETBACKS IN
THE RESIDENTIAL SINGLE - FAMILY ZONE.
VARIANCE NO. 88-7
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a variance from the terms of the
Zoning Ordinance of the City of Cypress to allow an existing 270 square foot
detached structure to be used as a guest dwelling unit, and to allow the
structure to encroach 7 feet into the rear yard setback and 2.5 feet into the
side yard setback at 5321 Yorkshire Drive.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. Strict or literal interpretation and enforcement of the
specified regulations would result in practical difficulty or
unnecessary physical hardship in that the structure is already in
existence.
b. The granting of the variance as conditioned will not constitute
the granting of a special privilege inconsistent with the limitations on
other properties in the vicinity.
c. The granting of the variance will not be detrimental to the
public health, safety, or welfare, or materially injurious to properties
or improvements in the vicinity since it has previously existed without
impacts.
d. If parking becomes a problem, the conditional use permit may
be modified or revoked, subject to a public hearing.
4. The City Council DOES HEREBY GRANT said variance subject to the
following conditions:
' a. The applicant shall comply with all requirements of the City
Code except for approved variances.
b. The guest dwelling unit to the rear of the single - family
residence shall be used on a temporary basis, by a non - paying guest of
the resident family. Renting of the guest dwelling is prohibited.
c. If parking becomes a problem or substantiated complaints are
received, the conditional use permit, after a public hearing, shall be
modified to add additional conditions or terminated.
