Resolution No. 3531357 RESOLUTION NO. 3531 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF CYPRESS TO PERMIT A MONUMENT SIGN WITHIN 300 FEET OF AN EXISTING ENTRY SIGN. VARIANCE NO. 88 -9 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a variance from the terms of the Zoning Ordinance of the City of Cypress to permit a monument sign within 300 feet of an existing entry sign. The monument sign is proposed to be located on Valley View Street, 120 feet north of the existing Corporate Drive entry sign. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. Strict or literal interpretation and enforcement of the specified regulations would result in practical difficulty or unnecessary physical hardship in that the subject parcel would not be permitted to construct a freestanding monument sign due to the proximity of the lot to the project entrance sign. b. The granting of the variance as conditioned will not constitute the granting of a special privilege since other businesses within the City are permitted to construct a freestanding monument sign to advertise the business. c. The granting of the variance will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity. d. The proposed variance will not create a proliferation of signs adjacent to Valley View Street since a monument sign will not be permitted on the corner parcel of Valley View Street and Cerritos Avenue. 4. The City Council DOES HEREBY GRANT said variance subject to the conditions in Exhibit "A" attached. Monument signs are required to be a maximum of four feet (4') high. 2. Signs shall be constructed with similar design as the address signs located on other parcels in the PC -5 Zone. 3. A comprehensive sign program for the monument signs requested in Variance Nos. 88 -9 and 88 -10 shall be submitted for Planning Department approval under design review prior to any signing installation. The developer shall not erect or display on the subject property any signs which have not been approved in writing by the Planning Department. 4. Signs shall be maintained in a safe appearance; i.e., free of broken, missing or significantly cracked surface finished materials. 5. This approval is for a sign advertising Chili's Restaurant and Woodfin Suites only. In the event either Chili's Restaurant or Woodfin Suites are not constructed and a new business opens in their locations, the subject sign may not advertise the new business without prior Planning Department design review and approval. 6. The applicant shall obtain necessary building and electrical permits and comply with all requirements of the Cypress Building and Safety Division. 7. The applicant /developer shall submit to the Planning Department written approval from the Orange County Flood Control District to allow construction of the sign over the Bolsa Chica Channel prior to the issuance of building permits. 8. This variance shall not become effective until the Cypress View Limited Specific Plan and Zoning Ordinance are amended to prohibit all freestanding pole or monument signs, except for one small directional sign for Carl's Jr. Drive -Thru Restaurant (as per Condition 34 in Conditional Use Permit No. 89 -1), on the Pavilion shopping center's parcel, which is located at the southwest corner of Valley View Street and Cerritos Avenue.
