Resolution No. 3532RESOLUTION NO. 3532 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF CYPRESS TO ALLOW THREE OFFSITE SIGNS. VARIANCE NO. 88 -10 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a variance from the terms of the Zoning Ordinance of the City of Cypress to allow three offsite signs in various areas near the southwest corner of Valley View Street and Cerritos Avenue. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. Strict or literal interpretation and enforcement of the . specified regulations would result in practical difficulty or unnecessary physical hardship due to the low visibility of the Woodfin Suites and Carl's Jr. locations from a major arterial street. b. The granting of the variance as conditioned will not constitute the granting of a special privilege since other major commercial tenants within the business park area have signs adjacent to a major arterial street. c. The granting of the variance will not be detrimental to the public health, safety or welfare or materially injurious to properties or improvements in the vicinity. d. The proposed variance will not create a proliferation of signs adjacent to Valley View Street. Carl's Jr. Restaurant is permitted to install a small directional sign adjacent to Valley View Street on the Pavilion Shopping Center site with the condition that the subject sign be removed in the event Carl's Jr. Restaurant relocates their business. Additionally, the specific plan is required to be amended to prohibit any additional signs to be located on the Pavilion site. 4. The City Council DOES HEREBY GRANT said variance subject to the conditions in Exhibit "A" attached. Monument signs are required to be a maximum of four feet (4') high. 2. Signs shall be constructed with similar design as the address signs located on other parcels in the PC -5 Zone. 3. A comprehensive sign program for the monument signs requested in Variance Nos. 88 -9 and 88 -10 shall be submitted for Planning Department approval under design review prior to any signing installation. The developer shall not erect or display on the subject property any signs which have not been approved in writing by the Planning Department. 4. Signs shall be maintained in a safe appearance; i.e., free of broken, missing or significantly cracked surface finished materials. 5. Sign one, advertising Woodfin Suites Hotel, is the only offsite business permitted to be advertised on signs one and two described in staff report for Variance Nos. 88 -9 and 88- 10. In the event the Woodfin Suites Hotel is not constructed or a new business opens in their location, signs one and two may not advertise the new business name without prior Planning Department design review and approval. 6. This variance shall not become effective until the Cypress View Limited Specific Plan and Zoning Ordinance are amended to prohibit all freestanding pole or monument signs, except for one small directional sign for Carl's Jr. Drive -Thru Restaurant (as per Condition 34 in Conditional Use Permit No. 89 -1), on the Pavilion shopping center's parcel, which is located at the southwest corner of Valley View Street and Cerritos Avenue. 7. The applicant shall obtain necessary building and electrical permits and comply with all requirements of the Cypress Building and Safety Division. 8. The applicant /developer shall submit to the Planning Department written approval from the Orange County Flood Control District to allow construction of the sign over the Bolsa Chica Channel. 9. This variance shall not become effective until the Cypress View Limited Specific Plan and Zoning Ordinance are amended to prohibit a freestanding sign on the Pavilion parcel, which is located at the southwest corner of Valley View Street and Cerritos Avenue.
