Resolution No. 3571RESOLUTION NO. 3571 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING PARCEL MAP NO. 89 -187 - WITH CONDITIONS. WHEREAS, an application was made by Cypress Land Company to subdivide two parcels into four parcels including a street dedication of Phyllis Drive. This property is located on the southeast corner of Valley View Street and Katella Avenue. WHEREAS, the City Council considered evidence presented by the applicant, City staff and other interested parties at a public meeting held with respect thereto. NOW, THEREFORE, the City Council of the City of Cypress DOES HEREBY RESOLVE as follows: 1. The proposed map is compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that: a. The proposed subdivision conforms with the Land Use Element of the General Plan and the PC -2 Planned Community Business Park Zone. b. The proposed subdivision is consistent with all provisions of the City's Subdivision Ordinance and the State Subdivision Map Act. c. Full public street improvements adjacent to the property and Phyllis Drive, a non - arterial street, will be completed to accommodate any anticipated increase in traffic generated from this project. d. The developer has agreed to pay for traffic impact mitigation improvements as identified as Exhibit "A" of the conditions of approval for Conditional Use Permit No. 89 -4. e. All applicable conditions of Conditional Use Permit No. 89 -4 shall be part of the parcel map approval as though attached hereto. f. The developer will comply with the reporting and monitoring requirements of the mitigation monitoring program for this project. 2. The design and improvement of the proposed consolidation as designated on the parcel map and supplemented by the conditions attached hereto as Exhibit "A," and incorporated herein by reference, are compatible with the objectives, policies, general land uses and programs specified in the General Plan of the City of Cypress in that: a. The subject property shall be improved in conformance with present zoning and all applicable ordinances in effect at the time this map is recorded with the County of Orange. All necessary utility services shall be provided to the property in conformance with the Cypress Municipal Code. 3. None of the findings set forth in Government Code Section 66474 can be made. 4. The discharge of waste from the proposed consolidation into the existing community sewer system shall not result in a violation of the existing requirements prescribed by the California Regional Water Quality Control Board having jurisdiction over the proposed consolidation pursuant to the provisions of Division 7 of the California Water Code (Sections 13000 et seq.). Denial of consolidation for violation of the proposed waste discharge standards or an addition to an existing violation thereof, is a ground for denial of the parcel map, although such denial is not mandatory. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Parcel Map No. 89 -187, subject to the conditions attached hereto as Exhibit "A." 486 PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cypress on the 8th day of May 1989. The developer shall conform to all applicable provisions of the City Code. All requirements of the State Subdivision Map Act, and the City's Subdivision Ordinance and Zoning Ordinance shall be satisfied. A final parcel map shall be recorded prior to issuance of certificate of occupancy. 2. All applicable conditions of Conditional Use Permit No. 89 -4 shall become a part of these conditions as though attached hereto. 3. The developer shall dedicate, for roadway and public utility purposes, an additional eleven feet (11') on the south side of Katella Avenue, from Valley View Street to the west side of the proposed north -south street, shown on the Amended Specific Plan No. 88 -1, between Valley View Street and Hope Street. The total half- street right -of -way of Katella Avenue in this area shall be eighty -five feet (85') from Valley View Street to a point approximately one hundred fifty feet (150') east, and seventy -one feet (71') for the remaining distance. The corner cut -off at the corner of Valley View Street and Katella Avenue shall be dedicated to the City of Cypress for street and public utility purposes. 4 The developer shall dedicate for roadway purposes an additional six -foot (6') width on Valley View Street south of Phyllis Drive, and of a length sufficient to 'accommodate the deceleration lane required in Condition 10 of Conditional Use Permit No. 89 -4. 5. As a condition precedent to the issuance of the parcel map by the City, the developer /applicant shall have met and completed all reporting and monitoring requirements up to and including the date of filing for said parcel map required by the project's mitigation monitoring program as set forth in the Resolution Certifying the Environmental Impact Report or subsequent Mitigation Monitoring Agreement. Failure by the developer /applicant to comply with said reporting and monitoring requirements prior to making application for said parcel map shall cause for the City to revoke said parcel map and to deny any further permits and /or approvals until such time as the developer /applicant is in full compliance with his /her obligations under the mitigation monitoring program for the project. 433 - 2 - 6. If at any time after issuance of the parcel map by the City, the developer /applicant fails to comply with the reporting and monitoring requirements for the mitigation monitoring program for this project, such failure shall constitute grounds for revocation of said parcel map.
