A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO. 89 -11 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of the
City of Cypress for construction of an automotive center to be located at
5051 Lincoln Avenue.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. The subject automotive center is consistent with the City of
Cypress Zoning Ordinance and City of Cypress General Plan.
b. The proposed land use is compatible with surrounding commercial
and residential uses.
c. Adequate access, parking and circulation will be provided.
d. The proposed development represents an upgrade of the property,
thereby contributing to the revitalization of Lincoln Avenue.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Conditional Use Permit No. 89 -11, subject to
the conditions attached as Exhibit "A ".
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 24th day of July 1989.

CONDITIONS OF APPROVAL
1. The applicant /developer shall comply with all provisions of
the City Code.
2. All requirements of the Orange County Fire Marshal's Office
shall be complied with prior to a Certificate of Occupancy
being issued.
3. All requirements of the Orange County Fire Marshal's Office,
Orange County Health Department, and Cypress Building and
Safety Department shall be satisfied prior to commencement
of the business operation.
4. Architectural elevations and site plans shall be reviewed
and approved by the Planning Department prior to Building
Department plan check submittal.
5. All architectural treatments shall be constructed as
illustrated on plans and renderings submitted. The final
exterior color scheme shall be submitted to City staff for
review and approval prior to actually painting the
structure.

7. A detailed landscape and automatic irrigation plan shall be
submitted to the Planning Department for review and approval
at least sixty (60) days prior to issuance of a Certificate
of Occupancy. In addition, a bond shall be posted with the
Public Works Department to guarantee against any defects in
plant materials and workmanship.
8. A comprehensive sign program for both building and
freestanding monument signs shall be submitted for Planning
Department approval prior to any signing installation. The
developer shall not erect or display on the subject property
any signs which have not been approved in writing by the
Planning Department.
9. Compact parking space aisles shall be denoted as such on the
asphalt as "Compact Only ".
10. Parking for the handicapped shall be provided in accordance
with State requirements.

11. All product and material storage shall occur within the
building. Exterior storage is specifically prohibited.
12. Outside public address speakers, telephone bells, buzzers
and similar devices which are audible on adjoining
properties are hereby prohibited.
13. All roof mounted equipment, such as heating and air
conditioning units, shall be adequately screened from public
view subject to the approval of City staff. Commercial or
industrial developments which adjoin residentially zoned
areas shall construct noise bafflers and /or deflectors on
all mechanical equipment mounted outdoors, to the
satisfaction of City staff.
14. Onsite security lighting shall be arranged so that direct
rays will not shine on adjacent properties or produce glare
for street traffic.
15. The developer shall provide an adequate number of trash
enclosures onsite and at a location acceptable to City
staff.
15. The transformer boxes and water valves shall be placed in
locations acceptable to the Planning Director and shall be
adequately screened from view with plant materials.
17. The rear access door to the business premises facing
adjoining single - family residences shall remain closed
during all hours of business operation. Said door shall be
designated and used for emergency exit purposes only.
18. Utilities shall not be released until all conditions of
approval have been met to the satisfaction of the Planning
Department.
19. The applicant shall obtain a Cypress business license prior
to commencement of the business operation.
20. The City Council shall maintain the right to review the auto
center's hours of operation and may, subject to a public
hearing, limit the business hours should substantiated
complaints be received that the business hours are creating
an adverse impact upon neighboring properties.
21. Conditional Use Permit No. 87 -35 shall be restricted to the
following auto related uses: tire sales and service; window
tinting; auto detail; auto sound, cellular phones and alarm
systems; auto glass; oil change and tune -up services. Any
addition of uses not listed shall require an amendment to
this Conditional Use Permit.

22. All hazardous waste materials, including oil and any other
automotive fluids or materials, shall be disposed of in
accordance with County of Orange Health Care requirements
and State and City laws. All trash shall be disposed of in
a trash container approved by the City of Cypress.
23. All overnight storage and /or vehicles shall be within the
interior building bays and shall be secure.
24. All onsite billboards shall be removed prior to commencement
of project construction.
25. An exterior noise study shall be performed prior to release
of Certificate of Occupancy on all mechanical equipment
associated with the development. Any excessive noise shall
be mitigated per the Orange County Noise Specialist.
26. The twenty foot (20') landscaped area along the north
property line adjacent to the residence shall consist of
landscaped screening, subject to design review. The west
wall of the subject landscaped area shall be removed.
