RESOLUTION NO. 3630
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
GRANTING A VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF
THE CITY OF CYPRESS TO ALLOW THE OPERATION OF A
RECREATIONAL VEHICLE STORAGE YARD
VARIANCE NO. 89 -16
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a variance from the terms of the
Zoning Ordinance of the City of Cypress to allow the operation of a
recreational vehicle storage yard in the rear parking lot of the property
located at 5171 -83 Lincoln Avenue.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. The granting of a variance will not be detrimental to the
public health, safety, welfare, or materially injurious to properties or
improvements in the vicinity because it will meet all building code and
traffic circulation requirements.
b. There are exceptional or extraordinary circumstances or
conditions applicable to the property whereby the existing and proposed
uses do not generate sufficient pedestrian or vehicular traffic to
create a detrimental effect on the surrounding neighborhood.
c. The proposed use has been operating within the subject
location and no adverse impacts have occurred.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Variance No. 89 -16, subject to the conditions
set forth in Exhibit "A" attached.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 9th day of October 1989.

CONDITIONAL USE PERMIT NO. 89 -19 AND
VARIANCE NO. 89 -16
CONDITIONS OF APPROVAL
1. The applicant /developer shall comply with all provisions of the
City Code.
2. The requirements of the Orange County Fire Marshal's office,
Orange County Health Department, and Building and Safety
Department shall be satisfied prior to commencement of the
business operation.
3. The applicant shall not erect or display on the subject property
any signs which have not been approved in writing by the Planning
Department. All signs shall conform to the approved sign
criteria.
4. The City Council shall maintain the right to review the
recreational vehicle storage yard's hours of operation and may,
subject to a public hearing, limit the business hours should
substantiated complaints be received that the business hours are
creating an adverse impact upon neighboring businesses within the
shopping center and adjacent properties.
5. All product and material storage shall occur within the building.
Exterior storage is specifically prohibited.
6. Should the operation of the recreational vehicle storage yard
create a parking problem within the commercial center, the City
Council may require, subject to a public hearing, a reduction in
the number of recreational vehicles allowed to be parked or stored
on the property.
7. All debris-and paint cans shall be removed from the subject site
prior to Conditional Use Permit No. 89 -19 and Variance No. 89 -16
becoming valid.
8. The parking area shall be restriped as per proposed plans prior to
Conditional Use Permit No. 89 -19 and Variance No. 89 -16 becoming
valid.
9. The gate to the rear of the property shall be open during business
hours for traffic circulation.
10. A maximum of sixteen (16) recreational vehicles or trailers shall
be parked or stored on the site.

11. The hours that recreational vehicles can be moved in or out of the
site are limited to 7:00 a.m. to 8:00 p.m. Monday through Saturday
and 9:00 a.m. to 8:00 p.m. Sundays or federal holidays. Ingress
and egress of recreational vehicles or trailers (moving on and off
property and entering or exiting trailer or vehicle itself) are
limited to the following hours: 7:00 a.m. to 8:00 p.m. Monday
through Saturday and 9:00 a.m. to 8:00 p.m. Sundays or federal
holidays. All other times are prohibited.
12. This conditional use permit may be modified or revoked by the City
Council should the Council determine that the proposed use or
conditions under which it is being operated or maintained is
detrimental to the public health, safety, or welfare, or
materially injurious to properties or improvements in the
vicinity.
13. The property owner and business owners of the RV storage waive all
relocation benefits possible through any future redevelopment
process.
