A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, AND ACTING AS
EX- OFFICIO BOARD OF DIRECTORS OF THE CYPRESS RECREATION AND PARK
DISTRICT, A SUBSIDIARY DISTRICT OF THE CITY OF CYPRESS, AMENDING
RESOLUTION NO. 970 PERTAINING TO RELATIONS AND COMMUNICATIONS BETWEEN
THE CITY OF CYPRESS AND ITS EMPLOYEES.
WHEREAS, the City Council of the City of Cypress has heretofore
adopted its Resolution No. 970, entitled "A Resolution of the City
Council of the City of Cypress Promoting Improved Relations and
Communication Between the City of Cypress and Its Employees;" and,
WHEREAS, in said Resolution No. 970, this City Council
established certain "Employee Groups for Recognition;" and,
WHEREAS, the City Manager has recommended to the City Council
that the number of "Employee Groups for Recognition" be expanded, and
the Council wishes to implement said recommendation.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS, AND
ACTING AS EX- OFFICIO BOARD OF DIRECTORS OF THE CYPRESS RECREATION AND
PARK DISTRICT, HEREBY DOES RESOLVE as follows:
SECTION 1.
Section 4 of the aforementioned Resolution No. 970 hereby is
amended to read as follows:
SECTION 4. EMPLOYEE GROUP FOR RECOGNITION
In order to be recognized for the purposes of meeting and
conferring, and employee organization must represent a majority
of the employees in an Employee Group for Recognition.
The City has investigated and studied the work assignments
and interests of all City employees. The City has made
conclusions based on this study that there are six (6) separate
and distinct Employee Groups for Recognition that will be the
groups most conducive to harmonious Employer - Employee relations
and to the efficient operation of the City. The six (6)
separate Employee Groups for Recognition are:
(1) All police employees, including sworn and non -sworn
employees; but excluding management and confidential employees
and the classifications of Executive Secretary, Office
Assistant, Police Clerk and such other clerical positions that
may from time to time be added to the Department;
(2) All employees of the City whose positions are classified as
"Maintenance Worker I, Maintenance Worker II, Maintenance
Specialist, Mechanic, Mechanic /Fabricator, Assistant Mechanic,
Street Sweeper Operator, and similar positions as may be adopted
or reclassified in the future;
(3) All employees of the City whose positions are classified as
Public Works Maintenance Supervisor and similar positions as may
be adopted or reclassified in the future;
(4) All employees of the City whose positions are classified as
Police Lieutenant and Police Captain;
(5) All general government employees, including all employees
of the City engaged in general governmental functions, but
excluding the following:
(a) Those employees identified in Subsections (1), (2),
(3), and (4) hereof, and
(b) Management and confidential employees.

(6) All middle management employees, including certain
confidential employees whose positions are classified as
Assistant City Engineer, Building Official, Administrative
Analyst, Personnel Analyst, Risk Management Technician, Data
Processing Manager, Finance Operations Manager, Assistant to the
Recreation and Park Director, Recreation Services Manager,
Executive Coordinator /Deputy City Clerk, Public Works
Superintendent, and similar positions or classifications as
maybe adopted or reclassified in the future.
SECTION 2. DECLARATORY OF EXISTING RELATIONSHIPS.
With the exception of the creation of the Employee Group for
Recognition specified in Subsection (6) of the aforesaid amended
Section 4 of Resolution No. 970; the Employee Groups for Recognition
identified in said Section 4 reflect the past and present practices of
the City and of the employee organizations which represent employees
of the City.
SECTION 3. SEVERABILITY.
If any section, subsection, subdivision, sentence, clause,
phrase or portion of this resolution, or the application hereof to any
person or place, if for any reason held to be invalid or
unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this resolution or its application to other
persons or places. The City Council hereby declares that it would
have adopted this resolution, and each section, subsection,
subdivision, sentence, clause, phrase or portion thereof, irrespective
of the fact that any one or more sections, subsections, subdivisions,
sentences, clauses, phrases or portions, or the application thereof to
any person or place, be declared invalid or unconstitutional.
PASSED AND ADOPTED by the City Council of the City of Cypress,
and acting as ex- officio Board of Directors of the Cypress Recreation
and Park District, at a regular meeting held on the 9th day of
October, 1989.
