A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, COUNTY OF
ORANGE, STATE OF CALIFORNIA, GIVING NOTICE OF AND APPOINTING A TIME
AND PLACE FOR HEARING PROTESTS IN RELATION TO THE PROPOSED IMPROVEMENT
REFERRED TO IN RESOLUTION OF INTENTION N0. 3643.
WHEREAS, the City Council of the City of Cypress, County of
Orange, State of California, did, in Resolution No. 3639 of said
Council, adopted October 30, 1989, pursuant to the provisions of
Division 14, Part 1, Streets and Highways Code, State of California,
as amended, hereinafter referred to as the "Street Lighting Act of
1919 ", require the City Engineer of said City to make and file with
the City Clerk of said City a written preliminary report presenting
certain matters relating to a proposed installation and maintenance of
a street lighting system, which system is Cypress Lighting District
No. 2; and
WHEREAS, the City Engineer, pursuant to the requirements of said
City Council, expressed in Resolution No. 3639 and of said Street
Lighting Act of 1919, did make and file in the office of the City
Clerk of the City of Cypress, California, his written preliminary
report relating to the proposed installation of a street lighting
system in Cypress Lighting District No. 2; and
WHEREAS, the City Council of said City has proceeded to carefully
examine, inspect and consider said preliminary report, and has
afforded all persons interested an opportunity to be heard with
reference thereto and is satisfied with said preliminary report and
with each and all the various items thereof and the matters therein
set forth; and
WHEREAS, after the approval of said preliminary report, and in
conformity with the provisions of said Street Lighting Act of 1919,
said City Council did duly and regularly adopt Resolution of Intention
No. 3643 entitled, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CYPRESS, COUNTY OF ORANGE, STATE OF CALIFORNIA, DECLARING ITS
INTENTION TO ORDER A STREET LIGHTING SYSTEM ON CERTAIN STREETS IN THE
CITY OF CYPRESS, TO BE INSTALLED AND MAINTAINED AND ELECTRIC CURRENT
TO BE FURNISHED FOR LIGHTING SAID SYSTEM FOR A PERIOD OF ONE (1) YEAR
BEGINNING JANUARY 1, 1990, AND ENDING JANUARY 1, 1991 "; and
WHEREAS, it now becomes the duty of this Council to appoint a
time and place for hearing protests in relation to the proposed
improvement referred to in said Resolution of Intention No. 3643 , and
to direct the giving of notice of said hearing.
NOW, THEREFORE, IT IS HEREBY RESOLVED, DECLARED, DETERMINED AND
ORDERED BY THE CITY COUNCIL OF THE CITY OF CYPRESS, COUNTY OF ORANGE,
STATE OF CALIFORNIA, AS FOLLOWS:
SECTION 1. That the llth day of December, 1989, at the hour
of 7:30 p.m. of said day, be, and the same is hereby appointed as, the
place for hearing the proposed improvement.
SECTION 2. That the City Clerk of the City of Cypress is
hereby authorized, designated and directed to give notice of said
hearing in the time, form and manner as required by the Street
Lighting Act of 1919.
SECTION 3. The City Council of the City of Cypress hereby
declares that there is no daily or weekly newspaper published and
circulated in the City of Cypress. The City Clerk of the City of
Cypress is hereby directed to post notice of said hearing for four
days, in three public places in the City of Cypress, pursuant to
Section 18013 of the Street Lighting Act of 1919.
SECTION 4. That the City Clerk shall certify as to the
adoption of this Resolution and the same shall thereupon take effect
and be in force.
PASSED AND ADOPTED by the City Council of the City of Cypress, at
a regular meeting held on the 13th day of November, 1989.
