Resolution No. 3649190 RESOLUTION N0. 3649 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS CALLING FOR THE FORMATION OF A PROJECT AREA COMMITTEE FOR THE LINCOLN AVENUE REDEVELOPMENT PROJECT AND APPROVING A PROJECT AREA COMMITTEE FORMATION PROCEDURE. WHEREAS, the City Council of the City of Cypress designated the boundaries of a redevelopment survey area and requested said survey area to be studied to determine if a redevelopment project, or projects, within said area are feasible; and WHEREAS, the Cypress City Council acting as the Cypress Planning Agency has adopted boundaries for the Lincoln Avenue Redevelopment Project from within said survey area; and WHEREAS, Section 33385 of the California Health and Safety Code requires that the City Council call for the formation of a Project Area Committee when a substantial number of low -and moderate - income residents would be displaced by the Project; and WHEREAS, the Cypress City Council desires to form a Project Area Committee, which Committee will advise the Agency regarding redevelopment planning and policy in the Lincoln Avenue Redevelopment Project. NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Cypress as follows: SECTION 1: The City Council of the City of Cypress hereby calls for the formation of a Project Area Committee. SECTION 2: The Council hereby adopts the procedure for the formation of said Project Area Committee, which procedure is attached hereto as Exhibt "A" and made a part hereof. AB4138] to require city councils to establish procedures for the formation of a project area committee (PAC) when an agency proposes to form a new project area or add area to an existing project area which new project or addition would otherwise require the formation of a PAC. Under the law, the procedure is required to describe the method and timing for the formation of the PAC including the method and procedure for giving notice to the public regarding formation of the PAC. In keeping with the requirements of Community Redevelopment Law, the City of Cypress has approved the following procedures for the formation of a PAC in Cypress where the proposed Lincoln Avenue Redevelopment Project is reasonably expected to displace a substantial number of low and moderate income residents. The procedures center on providing notice and conducting meetings necessary to formulate a PAC for the Lincoln Avenue area. The procedures include the following steps and requirements: 1. The Agency shall conduct at least one public meeting to explain the establishment of, function of and opportunity to serve on the PAC. At the meeting, the Agency shall distribute copies of this procedure and the draft redevelopment plan, or the pertinent portions thereof. 2. The Agency shall publish at least one time in a newspaper of local circulation, notice of the meeting (in the form of a display ad) where the establishment of the PAC is to be explained, and where copies of the draft Redevelopment Plan, or pertinent portions thereof are to be distributed. 3. The Agency shall provide written notice of all subsequent PAC formation meetings to all mailing addresses in the proposed redevelopment project area whether such addresses be commercial or residential, business owners or business tenants. In addition to the public notice, the Agency shall include a -1- i9 scheduled date for the approval of the PAC membership by the Cypress City Council. 4. The composition of the PAC shall include, when applicable, residential owner occupants, residential tenants, business owners, and representatives of existing organizations within the project area. Members must be representative of the Project Area and must serve without compensation. The PAC shall advise the Cypress Redevelopment Agency concerning policy matters which deal with the planning and provision of residential facilities or replacement housing for those to be displaced by project activities. In addition, the PAC shall advise the Agency on other policy matters which affect the residents of the project area. Minutes of the meetings of the PAC shall be open and public and minutes shall be taken and provided to the Cypress Redevelopment Agency. Minutes and records of PAC meetings shall be open to public inspection. The PAC, once selected, shall advise the Cypress Redevelopment Agency throughout the period of preparation of the redevelopment plan and for a period of three years after adoption of the redevelopment plan, subject to one year extensions by the City Council.
