Resolution No. 3658RESOLUTION NO. 3658 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF CYPRESS TO ALLOW THE REDUCTION OF REQUIRED PARKING SPACES FOR THE RAMADA INN VARIANCE NO. 89 -17 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a variance from the terms of the Zoning Ordinance of the City of Cypress to allow the reduction of required parking spaces for the Ramada Inn located at 5865 Katella Avenue. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The City hired a consultant to conduct a parking study for the Ramada Inn site. The study determined that the reduction of parking spaces to a total of two - hundred (200) (one- hundred and seventy -six (176) on -site and twenty -four (24) shared parking off -site) will be sufficient to handle the needs of the hotel. b. Traffic and circulation problems have been addressed and mitigated in the McDonnell Center - Cypress Environmental Impact Report. c. The parking area is compatible with existing and proposed development. d. A Negative Declaration has been filed for the variance. No other environmental documentation is needed.. 4. The City Council DOES HEREBY GRANT said variance subject to the following conditions: a. All applicable conditions of Conditional Use Permit No. 86 -35 remain valid. b. The twenty -four (24) parking spaces that are located on the adjacent parcel may be used as shared parking with the parcel located to the east, with the condition that the twenty -four (24) shared parking spaces will be in addition to the minimum number of parking spaces required by the ordinance at the time the restaurants are approved. If a use other than restaurant use is constructed on the site, staff will review the shared parking request on an individual basis subject to the proposed use. c. A joint use agreement shall be required to connect the Ramada Inn parcel with the parcel to the east containing the subject twenty - four (24) parking spaces. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Variance No. 89 -17, subject to the conditions set forth in this Resolution.
