Resolution No. 3661RESOLUTION NO. 3661 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS SUPERSEDING RESOLUTION NO. 2904 AND SETTING FORTH THE LOCAL CONDITIONS UPON WHICH A DETERMINATION HAS BEEN MADE BY THE CITY COUNCIL THAT MODIFICATIONS TO CERTAIN OF THE FOLLOWING CODES ARE REASONABLY REQUIRED BY LOCAL CONDITIONS WITHIN THE CITY OF CYPRESS: THE 1988 EDITION OF THE UNIFORM PLUMBING CODE, THE 1988 EDITION OF THE UNIFORM SWIMMING POOL CODE AND THE 1988 EDITION OF THE UNIFORM SOLAR ENERGY CODE, AND THE UNIFORM PLUMBING CODE MATERIAL AND INSTALLATION STANDARDS. WHEREAS, Health and Safety Code Section 17922 requires the City of Cypress to adopt the most current editions of the Plumbing Codes; and WHEREAS, Health and Safety Code Section 17958.5 provides for the City Council to make changes or modifications in the most current editions of the Plumbing Codes as may be reasonably necessary because of certain local conditions; and WHEREAS, the Building Official of the City of Cypress has determined and recommended that, based upon certain local conditions within the City of Cypress, the modifications to the 1988 editions of the Plumbing Codes contained in Ordinance No. 835 are reasonably required to be adopted by the City of Cypress; and WHEREAS, Health and Safety Code Section 17958.7 requires the City Council to make express findings of the necessity for modifications in the most current editions of the Plumbing Codes; and WHEREAS, it is appropriate to describe the specific local conditions upon which each said modification is based. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress that the following amendments and modifications to the 1988 editions of the Plumbing Codes contained in Ordinance No. 835 are hereby found to be reasonably necessary due to consideration of specific local climatic, geological or topographical conditions as follows: I. UNIFORM PLUMBING CODE, 1988 EDITION A. The City of Cypress lies on soil which is considered sandy with a high water table which extends to a maximum of approximately three and one -half feet deep. This condition predisposes certain areas to rodents and organisms from which protection must be provided. (Section 903) B. Amendment. to Section 1009(h) is provided to require full accessibility to, and adequate pressure of, water syst-.ems for irrigation and modification purposes. C. All other ;modifications to this Code are administrative in nature. Il UNI('ORM SWIMMING POOL CODE, 1988 EDITION A. All modifications to this Code are administrative amendments of local discretion. III. ( JNIFORM SOLAR ENERGY CODE, 1988 EDITION A. All modifications to this Code are administrative amendments of local discretion. BE IT FURTHER RESOLVED that a copy of this Resolution, together with a copy of Ordinance No. 835 adopting the 1988 editions of the Plumbing Codes, as amended, be filed with the State Department of Housing and Community Development.
