A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
GRANTING A VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE
OF THE CITY OF CYPRESS TO ALLOW A ROOM ADDITION TO ALIGN
WITH THE EXISTING GARAGE SIDE YARD SETBACK.
VARIANCE NO. 90 -5
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a variance from the terms of the
Zoning Ordinance of the City of Cypress to allow a room addition aligning with
the existing garage side yard setback at 4576 Everest Circle, located in the
RS -6000 Residential Single - Family Zone.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. Strict or literal interpretation and enforcement of the
specified regulations would result in practical difficulty or
unnecessary physical hardship in that the subject parcel is smaller and
narrower than the standard lot size in the City.
b. There are exceptional or extraordinary circumstances or
conditions applicable to the property involved because of the reduced
size of the subject property.
c. Strict or literal interpretation and enforcement of the
specified regulation would deprive the applicant of privileges enjoyed
by owners of other properties in the same zone.
d. Due to the reduced size of the parcel, this variance will not
constitute the granting of a special privilege.
e. The granting of the variance will not be detrimental to the
public health, safety, welfare, or materially injurious to properties or
improvements in the vicinity because it will meet all building code
safety requirements.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Variance No. 90 -5, subject to the following
conditions:
1. The applicant shall comply with all requirements of the City Code
except for approved variances or adjustments.
2. Prior to the issuance of building permits, the final elevations and
site plan shall be reviewed and approved by the Planning Department.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 14th day of May, 1990.
