Resolution No. 378088 RESOLUTION NO. 3780 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO. 86 -35 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for an amendment to a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to operate an onsite car rental service at the Ramada Inn located at 5865 Katella Avenue in the PC -3 Planned Community Business Park Zone No. 3. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended to encourage the establishment of a planned community of balanced commercial and industrial uses in an area where it is deemed desirable to provide for varied business facilities and to establish standards of design and type of use which will enhance the area, be in harmony with the objectives of the City's General Plan, and minimize detrimental effects to the public health, safety, and welfare; to designate an area for modern industrial, office and commercial land uses that can meet high performance and development standards, while benefiting the community through growth, revenue generation and providing an increasing supply of citizen employment and services; and to allow diversification of specified land uses as they relate to each other in a physical and environmental arrangement, while insuring substantial compliance with the overall goals of the City as identified in the various elements of the General Plan. b. The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The proposed use is compatible with the hotel use and other planned community business park uses within the specific plan. (2) Adequate onsite parking is provided at the site to accommodate the proposed use. (3) If parking becomes a problem at the site, the City Council has the right to reopen the public hearing and modify or discontinue the use. (4) Notices of the public hearing were posted, published and mailed to all property owners within 300 feet of the subject property and staff has not received any negative communication regarding this project. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Amendment to Conditional Use Permit No. 86 -35, subject to the conditions attached hereto as Exhibit "A ". All applicable conditions of Conditional Use Permit No. 86- 35 remain valid. 2. The applicant shall comply with all applicable provisions of the City Code. 3. The City Council maintains the right to reopen the public hearing and modify or discontinue the use at any time, if it becomes apparent to the City, or substantiated complaints are received that parking has become a problem. 4. No more than twenty -five (25) vehicles shall be permitted on- site at any time. 5. The applicant shall maintain auditable records, accessible at all times to the City's Auditor's, indicating the usage of the rental vehicles by hotel guests. 6. A sign plan shall be submitted to the Planning Department for review and approval prior to the installation or issuance sign permits. 7. The applicant shall obtain a Cypress Business License prior to the commencement of the Business operation. 8. No servicing, washing or cleaning of the vehicles will be done on -site. 9. No vehicle shall be over two (2) model years old.
