RESOLUTION NO. 3804
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
DENYJHG WNW PREJUDICE CONDITIONAL USE PERMIT NO. 89 -30.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed by Barry Weiss in behalf of College
Health Enterprises for a conditional use permit in accordance with the
provisions of Section 9.1A9, 9.3G, and 17.2 of Appendix I, "Zoning ", of the
Code of the City of Cypress to operate an adolescent community care facility
to be located at 8542 Sumner Place in the RM -20 Residential, Multiple - Family
Zone.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby denies without prejudice said
conditional use permit because it is unable to make the following findings
required by Section 17.2 -7 of Appendix I, "Zoning ", of the Code of the City of
Cypress because:
a. The proposed location of the conditional use and the
conditions under which it would be operated or maintained will not
be detrimental to the public health, safety, or welfare or be
materially injurious to properties or improvements in the vicinity
because said project could not be conditioned to make it compatible
with surrounding single - family residential uses.
b. The applicant failed to demonstrate that adequate on -site
parking would be provided to ensure that employees, patient
families, and visitors would not contribute to on-street parking
problems.
4. That the City Council further denies without prejudice said
conditional use permit in accordance with Section 9.3G of Appendix I,
"Zoning ", of the Code of the City of Cypress because:
a. The proposed use while consistent with the multi- family zone is
inconsistent with the single - family residential nature of the
surrounding properties. Furthermore, the applicant was unsuccessful
in demonstrating that conditioning the use would make it compatible
with surrounding single- family residential uses.
5. Based on the foregoing findings of fact, the City Council finds and
determines that the public interests, convenience, and necessity determine
that this application be denied without prejudice.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby deny without prejudice Conditional Use Permit
No. 89 -30.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 13th day of August, 1990.
