A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING CONDITIONAL USE PERMIT NO. 90 -20 - WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS: -
1. That an application was filed for a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of the
City of Cypress to establish a church on a portion of the Mackay Elementary
School site at 8721 Cypress Avenue in the PS Public /Semi- Public Zone.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the conditional use is in accord with
the objectives of the Zoning Ordinance and the purpose of the zone
in which the site is located is:
Intended to permit adequate identification of areas reserved
and developed for public uses other than street rights -of -way,
to provide for expansion of their operations or change in use,
and to identify and preserve areas of historic and community
significance for the enjoyment of future generations.
b. The proposed location of
under which it would be operated
to the public health, safety or
properties or improvements in the
the conditional use and the conditions
or maintained will not be detrimental
welfare or be materially injurious to
vicinity in that:
(1) The operation of the church should not be any more
detrimental to the surrounding community than the former public
elementary school in that adequate parking will be provided onsite
and hours of church services are subject to regulation by the City
Council.
(2) Occupancy of the subject property will reduce the potential
for vandalism since the Mackay School has been vacated and closed
by the Cypress School District.
c. The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Conditional Use Permit No. 90 -20, subject to
the conditions set forth in Exhibit "A" attached.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 27th day of August, 1990.

CONDITIONAL USE PERMIT NO. 90 -20
CONDITIONS OF APPROVAL
1. The applicant shall conform to all applicable provisions of
the City Code.
2. On- street parking will not be permitted for the applicant's
activities.
3. It shall be the responsibility of the applicant to coordinate
the requirements of this conditional use permit with other
applicants at this site and the property owner.
4. Buildings shall comply with the regulations of Titles 19 and
24, California Administrative Code for Church (Public
Assembly Use).
5. Plans for any proposed signage shall receive final approval
from the City Design Review Committee.
6. Any changes in hours of operation, increase in number of
members greater than 250, or expansion of the use beyond what
is approved as part of Conditional Use Permit No. 90 -20 will
require an amendment to Conditional Use Permit No. 90 -20.
7. Should the increase in vehicle trips on Cypress Avenue
demonstrate the need for another access point, the City may
require the applicant to install a driveway off of Walker
Street. Traffic on Cypress Avenue will be monitored by the
Department of Public Works.
8. The Mackay Elementary School site shall be available for
publicly scheduled recreational uses during those hours when
the fields are not specifically being used by the church or
its related organizations.
9. Maximum occupancy shall be determined by the Building
Department.
