Resolution No. 38262,22 RESOLUTION N0. 3826 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS DENYING CONDITIONAL USE PERMIT NO. 90 -8 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to reconvert two existing one -story buildings, formerly used as a board and care facility, to a motel use located at 5271 Lincoln Avenue in the CH Commercial Heavy - Lincoln Avenue Combining Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council does hereby DENY said conditional use permit because it is unable to make the following finding required by Section 17.2 -7 of the Zoning Ordinance of the City of Cypress: a. That the proposed location of the conditional use is in accord with the objectives of this ordinance and the purpose of the zone in which the site is located. b. That the proposed location of the conditional use permit and the conditions under which it will be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity. c. That the proposed conditional use will comply with each of the applicable provisions of this ordinance except for approved variances. These findings could not be made due to the following circumstances: a. The existing use of the property indicates that the proposed motel would operate as a residential rather than a commercial use of the property which is inconsistent with the purpose of the zone in which the site is located. b. The conditions under which the proposed motel would be operated may be unsafe or detrimental to public health since the structures do not meet Uniform Building Code requirements for a fire sprinkler system and the number of residents may exceed the maximum allowed persons per unit. c. The proposed project did not meet minimal standards of planning and engineering design for a motel use including access and circulation, architectural quality, and landscaping. NON, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby DENY Conditional Use Permit No. 90 -8. PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 10th day of September, 1990.
