Resolution No. 3831RESOLUTION NO. 3831 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO. 90 -6 - WITH CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for an amendment to a conditional use permit in accordance with the provisions of Section 17.2 of the Zoning Ordinance of the City of Cypress to allow the offsite sale of beer and wine within a previously approved convenience market located at 4021 Orange Avenue in the CN Commercial Neighborhood Zone. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. The proposed location of the amended conditional use is in accord with the objectives of the Zoning Ordinance and the purpose of the zone in which the site is located is: Intended for neighborhood shopping centers which provide limited retail business service and office facilities for the convenience of residents of the neighborhood. These shopping centers are intended to be compatible with a residential environment at locations indicated on the general plan. b. The proposed location of the amended conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity in that: (1) The proposed location of the conditional use is in accord with the objectives of this ordinance and the purpose of the zone in which the site is located in that this is an amendment to an already approved conditional use permit. (2) The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity since the applicant has improved the site. (3) The proposed conditional use will comply with each of the applicable provisions of this ordinance except for approved variances. c. The proposed conditional use will comply with each of the applicable provisions of the Zoning Ordinance except for approved variances or adjustments. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City of Cypress does hereby approve Amendment to Conditional Use Permit No. 90 -6 subject to the approved conditions listed in Exhibit "A" of the original Conditional Use Permit No. 90 -6 as well as the following: 1. The hours of operation shall be from 7:00 a.m. to 8:00 p.a. Monday through Sunday. 2. Upon the City Council's approval of the sign ordinance update, the applicant shall immediately comply with the provisions for permitted signage within the CN Commercial Neighborhood Zone. The applicant shall satisfy all necessary requirements of the State Department of Alcoholic Beverage Control. 2. The City Council shall maintain ongoing jurisdiction over the hours of operation, with the right to review or limit the hours of operation should this use become detrimental to adjoining properties. 3. The back door shall be secured at all times except for fire emergency access. 4. The applicant shall meet all requirements of the Orange County Fire Marshall's Office, the Orange County Health Department, and the Cypress Building Department. All necessary building and electrical permits shall be obtained prior to interior remodeling. 5. A sign plan shall be submitted to the Planning Department for review and approval prior to the installation or issuance of sign permits. 6. All applicable conditions of approval shall be complied with prior to Conditional Use Permit No. 90 -6 becoming effective. 7. The applicant shall obtain a Cypress business license prior to commencement of the business operation.
