Resolution No. 3857RESOLUTION NO. 3857 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, AND ACTING AS EX- OFFICIO BOARD OF DIRECTORS OF THE CYPRESS RECREATION AND PARK DISTRICT, A SUBSIDIARY DISTRICT OF THE CITY OF CYPRESS, AMENDING RESOLUTION NO. 1635, RULES AND REGULATIONS, CHAPTERS 4 AND 5, SECTIONS 4.11 AND 5.04, CONCERNING FLEXIBLE STAFFING FOR EMPLOYEES OF THE CITY OF CYPRESS AND CYPRESS RECREATION AND PARK DISTRICT. WHEREAS, the City Council of the City of Cypress, and acting as ex- officio Board of Directors of the Cypress Recreation and Park District, is authorized and directed, under the provisions of the Personnel Ordinance, to adopt and, from time to time, to amend City /District Rules and Regulations for the administration of the Personnel System; and, WHEREAS, The City Council deems it necessary to amend the Personnel Rules and Regulations affecting City /District employees. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress, and acting as ex- officio Board of Directors of the Cypress Recreation and Park District, that Chapters 4, Section 4.11, and Chapter 5, Section 5.04, are hereby amended as follows: CHAPTER 4. APPLICATIONS, APPLICANTS AND EMPLOYMENT Section 4.11 Types of Appointments. (Add subsection 7) 7. Flexible Staffing Appointments: pursuant to the approved classification plan, certain designated positions for entry and journey skills shall be administered considering the merits of the "Flexible Staffing" concept, as defined in said document. When a candidate is appointed at the journey level position, the following procedures will not apply. The change in status of the employee from entry to journey level shall be considered an upgrade and is based on merit similar to step increases. The departments utilizing said designated positions shall use the following procedure for administration purposes. A. Budget Designation - During the budget process, or by a budget modification, the Department shall identify positions that shall be part of the flexible staffing classifications. B. Minimum Qualifications - The department shall only consider a change when the employee meets or exceeds the minimum qualifications of the journey level position. The Personnel Officer, as deemed necessary, may review the employee's successful completion of an examination to ensure employee possesses the skills and minimum qualifications required for the journey position. Advancement to the journey level position is not based on tenure in the entry level position; prior equivalent experience may be considered. C. Performance Evaluation Required - The department shall complete an evaluation of the employee's performance, and advancement to the higher position shall only be considered upon the recommendation of the department head. D. Personnel Forms Required - After completion of the above process, the department shall complete a Personnel Action Form requesting change in status from entry level to journey level, subject to the approval of the City Manager or his designee. E. Compensation for Upgrade - See Chapter 5, Section 5.04. CHAPTER 5. COMPENSATION AND HOURS Section 5.04. Advancement Within Salary Range. (Add fifth paragraph) Flexible Staffing Compensation: This section relates to the flexible staffing conditions set forth in Chapter 4, Section 4.11, subsection (7). An employee who qualifies under Section 4.11, subsection (7), shall have his /her compensation elevated to the appropriate designated step in the higher classification range. The minimum increase is approximately 5% of the employee's current salary, or Step A of the new salary range, whichever is higher. Advancement in the steps shall follow the normal advancement procedures. These amendments shall become effective October 29, 1990.
