A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A VARIANCE
FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF CYPRESS TO ALLOW A
GARAGE ADDITION TO ENCROACH FIVE FEET (5') INTO THE SIDE YARD SETBACK.
VARIANCE N0. 90 -22
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a variance from the terms of the
Zoning Ordinance of the City of Cypress to allow a garage addition to encroach
five feet (5') into the side yard setback located at 5111 Marion Avenue within
the RS -6000 Residential Single-Family Zone.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. Strict or literal interpretation and enforcement of the
specified regulation would deprive the applicant of privileges enjoyed by
owners of other properties in the same zone.
b. This variance will not constitute the granting of a special
privilege since other property owners in the same neighborhood have been
allowed to build similar additions.
c. The granting of the variance will not be detrimental to the
public health, safety, welfare, or materially injurious to properties or
improvements in the vicinity because it will meet all building code safety
requirements.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Council of the City
of Cypress does hereby approve Variance No. 90 -22 subject to the conditions
set forth in Exhibit "A" attached.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 28th day of January , 1991.

VARIANCE NO. 90 -22
CONDITIONS OF APPROVAL
1. The fence along the west property line shall not extend
closer than thirty -five feet (35') from front property line.
2. The front porch light shall adequately illuminate the front
door area subject to the Police and Planning Departments
approval.
3. Prior to the issuance of building permits, the final
elevations and site plan shall be reviewed and approved by
the Planning Department.
4. All architectural treatments shall be constructed as
illustrated on plans and renderings submitted.
5. Exterior building materials and colors shall match the
existing structure.
6. Applicant /developer shall comply with applicable provisions
of the 1988 Uniform Building, Plumbing and Mechanical Codes,
1987 National Electrical Code, California Administrative
Code, Title 24, and the Cypress City Code.
7. Type 5 cement shall be used for all foundations and slabs on
grade.
8. All slabs on grade (including M -1 occupancies) shall receive
a minimum of a 10 mil. moisture barrier.
