Resolution No. 160255 RESOLUTION NO. 1602 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS EXPRESSING ITS OPPOSITION TO ASSEMBLY BILL NO. 15. The City Council of the City of Cypress hereby does find, determine, order and resolve as follows: 1. Assembly Bill No. 15 attempts to establish a comprehensive program for the preservation of prime agricul- tural land in order to provide protection against food short- ages on a state, national, or global level. While this City Council finds such a concept praiseworthy, it must oppose Assembly Bill No. 15, as presently drafted, and urge others to do likewise for the reasons set forth hereinbelow. 2. The term "prime agricultural land" is defined by Assembly Bill No. 15 so broadly as to include virtually all of the remaining undeveloped land within the City of Cypress as well as a substantial portion of that land which has here- tofore been developed. 3. Pursuant to the terms of Assembly Bill No. 15, as presently drafted, virtually no further urban development would be allowed to occur within the City of Cypress. 4. This prohibition against future urban development is not merely just another unnecessary and unwarranted intrusion by state government into a matter of purely local concern. Such a prohibition would frustrate virtually all land use planning heretofore undertaken by the City of Cypress, deprive the City forever of the opportunity of developing a viable tax base, and undermine the long -range financial planning and well -being of the City. 5. Moreover, by requiring that all "prime agricultural land" be assessed under Sections 423 and 423.5 of the Revenue and Taxation Code, the Bill, if adopted, would result in the loss of up to $55,000 per year in city controlled property tax revenues. Even more significantly, the Bill would result in a net loss of annual tax revenues controlled by the City of over $400,000 by reason of its prohibition against future urban development. 6. In addition to its adverse impact on undeveloped property within the City, Assembly Bill No. 15 would also prohibit the upgrading and improving of large portions of the City which have already been developed. 7. For the reasons set forth hereinabove, this Council hereby expresses its opposition to Assembly Bill No. 15, as presently drafted, and urges all other local governmental agencies to do likewise. The City Clerk hereby is authorized and directed to transmit copies of this resolution to the legislative repre- sentatives of the City and to such other public agencies and officials as he deems appropriate. 56 PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 12th day of May, 1975.
