Resolution No. 1605RESOLUTION NO. 1605 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS EXPRESSING ITS OPPOSITION TO SENATE BILL NO. 1183. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES FIND, DETERMINE, RESOLVE, AND ORDER AS FOLLOWS: 1. Senate Bill No. 1183, introduced by Senator Kennick, would, if adopted, add to Section 19495 of the Business and Professions Code a limitation of $.25 of the amount of the tax or fee which may be levied by a city in connection with the admission to, or parking at, any horse racing enclosure. 2. Such a limitation not only constitutes an unlawful interference with a matter of strictly municipal concern, it also establishes a completely arbitrary ceiling on the amount of revenue which may be raised by a municipality to offset the costs incurred by that munici- pality in connection with providing the extra services required by a horse racing establishment. Moreover, this arbitrary limitation would be established without regard to increases in either the cost of living or the price of admission to a horse racing facility. 3. This arbitrary limitation proposed by Senate Bill No. 1183 applies only to horse racing facilities and thereby unfairly and unlawfully discriminates in favor of such facilities and against other places of amusement with respect to which admission taxes are commonly levied. 4. The City of Cypress, in the exercise of the home rule power granted to it by its charter, presently levies an admissions tax applicable to all places of amusement, offering live entertainment, for which an admission fee is charged. The city is dependent upon the revenue raised by this tax to help offset the costs incurred by it in providing municipal services to such places of amusement. 5. In light of the above considerations, the City Council of the City of Cypress hereby expresses its unqualified opposition to Senate Bill No. 1183 in any form. The City Clerk of the City of Cypress hereby is authorized and directed to furnish copies of this Resolution to appropriate officials of state and local government.
