RESOLUTION NO. 1634
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
VACATING AND ABANDONING PORTION OF KATELLA AVENUE PURSUANT
TO THE PROVISIONS OF CHAPTER 5 ( §§ 1930 -1934) OF DIVISION
2.5 OF THE STREETS AND HIGHWAYS CODE OF CALIFORNIA.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY DOES RESOLVE;DETERMINE,
FIND AND ORDER AS FOLLOWS:
Section 1. An easement for public street purposes in certain portions of
Katella Avenue, described in Section 4 herein, has been dedicated to the City
of Cypress.
Section 2. Such portions of Katella Avenue have been superseded by relocation.
Section 3. The abandonment and vacation of such portions of Katella Avenue
would not cut off access to the property of any person which, prior to such re-
location, adjoined such street, and would not terminate any easement or right of
a type described in § 1934 of the Streets and Highways Code of California.
Section 4. Such portions of Katella Avenue which are described below, to wit:
The northerly 10 feet of the southerly 70 feet of the southeast quarter
of Section 20, Township 4 South, Range 11 West, in the Rancho Los Alamitos,
as shown on Map No. 2 attached to the Final Decree of Partition of said Rancho,
a certified copy of which was recorded February 2, 1891, in Book 14, page 31
of Deeds, records of said County.
are hereby ordered vacated and abandoned pursuant to the provisions of Chapter 5
( §§ 1930 -1934) of Division 2.5 of the Streets and Highways Code of California.
Section 5. There shall be excluded from the abandonment and vacation
set forth in Section 4 hereinabove, any and all easements and rights of way for
public purposes other than street purposes and there is specifically reserved to
the City of Cypress that easement for storm drain purposes granted to said City
by instrument dated and recorded on June 19, 1968, Book 8635, Page 181 and 183 of
the Official Records of Orange County.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the llth day of August, 1975.
