Resolution No. 3430 40 ) RESOLUTION NO. 3430 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, REQUESTING THE ORANGE COUNTY TRANSPORTATION COMMISSION TO ALLOCATE ORANGE COUNTY UNIFIED TRANSPORTATION TRUST (OCUTT ) FUNDS FOR THE INSTALLATION OF TRAFFIC SIGNAL COORDINATION EQUIPMENT ON KATELLA AVENUE, FROM SIBONEY STREET TO KNOTT AVENUE, AND ON VALLEY VIEW STREET, FROM LINCOLN AVENUE TO ORANGEWOOD AVENUE. CITY OF CYPRESS PROJECT NOS. 8675-50 AND 8676-50 WHEREAS, Chapter 1512 in the Statutes of 1985 allows the Orange County Transportation Commission to allocate funds from the rapid transit reserve to local agencies, for the improvement, construction or repair of local streets and roads; and WHEREAS, the Orange County Transportation Commission approved a twelve million dollar OCUTT Streets and Roads Program on April 14, 1986, covering fiscal years 1986-87 through 1988-89; and WHEREAS, the three-year program includes up to $119, 750. 00 in Fiscal Year 198'7-88 for a traffic signal coordination project on Katella Avenue, from Siboney Street to Knott Avenue, and on Valley View Street, from Lincoln Avenue to Orangewood Avenue. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cypress hereby requests that the Orange County Transportation Commission allocate to the City of Cypress $2, 025. 00 for construction engineering and $31, 470. 75 for construction, for a total of $33, 495. 75 in OCUTT funds. This request is in conformance with the OCUTT allocation process and does not exceed ninety percent ( 90% ) of the programmed amount for construction engineering or ninety percent ( 90% ) of the programmed amount for the construction contract. BE IT FURTHER RESOLVED, that the City of Cypress agrees to fund its share of the improvement costs in Fiscal Year 1988-89 and any additional costs over the programmed OCUTT amount of $119, 750. 00. BE IT FURTHER RESOLVED, that the City of Cypress has awarded the contract for the construction project on June 13, 1988, to Paul Gardner Corporation for $69, 935. 00. BE IT FURTHER RESOLVED, that the City of Cypress has ( 1 ) designed the project improvements in accordance with the City' s design standards; ( 2 ) has acquired rights-of-way for the project ( if any) in conformance with the City' s policies and procedures; and ( 3 ) has completed and certified all required environmental documentation for the project. BE IT FURTHER RESOLVED, that the remaining ten percent ( 10% ) in OCUTT funds will be transferred to the City of Cypress when construction is completed and a final report on the project is accepted by the Orange County Transportation Commission. The City of Cypress agrees to submit the final report to the Orange County Transportation Commission within ninety ( 90 ) days after the City' s acceptance of the improvements.
