Resolution No. 3452 84 RESOLUTION NO. 3452 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS .MIKING APPLICATION AND REQUESTING THE LOCAL AGENCY FORMATION COMMISSION TO UNDERTAKE PROCEEDINGS FOR THE DISSOLUTION OF THE CYPRESS COUNTY WATER DISTRICT AND NAMING THE CITY OF CYPRESS AS THE SUCCESSOR AGENCY. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, AND DETERMINES AS FOLLOWS: WHEREAS, by Resolution No. 196, adopted on June 17, 1987, the Board of Directors of the Cypress County Water District ( "District" ) requested dissolution of the District by the Local Agency Formation Commission ( "LAFCO" ) pursuant to Part 3 of the Cortese-Knox Local Government Reorganization Act of 1985 ( "the Act" ) , and in so doing stated that "because the boundaries of the District have diminished greatly over the years; because the present size of the District is so small that the District is no longer able to operate efficiently and economically; and because neighboring governmental entities are capable of absorbing the District and carrying on its functions, it is in the best interests of the District and its constituents that the district be dissolved" ; and, WHEREAS, since the adopton of Resolution No. 196, the City of La Palma has detached territory from the District, Orange County Reorganization No. 103; and, WHEREAS, the City of Cypress has received LAFCO approval for Annexation No. 88-1 conditioned upon a detachment of the territory within said annexation from the District; and, WHEREAS, the City Council of the City of Cypress has adopted a resolution ordering Annexation No. 88-1 without an election; and, WHEREAS, the territory within Annexation No. 88-i contains more than 85% of the territory remaining under the jurisdiction of the District; and, WHEREAS, the City of Cypress is in the process of negotiating agreements with neighboring governmental agencies to ensure that service is provided to the remainder of the District' s territory lying outside the City's boundaries; and, WHEREAS, a dissoluton of the District will expedite the transfer of sewer services to the City of Cypress and is recommended by the Executive Director of LAFCO; and, WHEREAS, the City of Cypress is "an affected local agency, " pursuant to Government Code Section 56800 which is authorized by the Act to apply for dissolution of the District; and WHEREAS, the City of Cypress will upon the effective date of dissolution of the District contain the greater assessed value of all taxable property within the territory of the District, as shown on the last equalized assessment roll of the County; and WHEREAS, the City of Cypress asserts that the territory affected by this action is deemed to be developed for purposes of determining reallocation of property tax revenues in accordance with the terms of the Master Property Tax Transfer Agreement; and, WHEREAS, the City of Cypress asserts that all property tax revenues which would have accured pursuant to Revenue and Taxation Code Sections 97 and 98 to the Cypress County Water District from the territory affected by this action had the District remained a separate governmental entity, should be reallocated to the City of Cypress commencing in the first fiscal year in which the jurisdictional change is effective for tax purposes as provided in Government Code Section 54902 . 1; and, WHEREAS, the City of Cypress desires to make application to LAFCO for the dissolution of the Cypress County Water District. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS DOES HEREBY FIND, RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1 . The City of Cypress hereby applies for the dissolution of the Cypress County Water District pursuant to Part 3 of the Cortese-Knox Government Reorganization Act of 1985 (commencing with Government Code Sections 56650) . SECTION 2 . That a summary description of the boundaries of the affected territory, accompanied by a map showing the boundaries, are attached hereby as Exhibits "A" and "B" , and are incorporated herein by this reference. SECTION 3 . That dissolution of the District is proposed because over 85% of the District's territory will be located within the City of Cypress by the time of the dissolution and the City of Cypress may more efficiently and economically provide sewer service to said territory. SECTION 4 . That this proposal has the unanimous support of the Board of Directors of the Cypress County Water District. SECTION 5. That this proposal is consistent with the sphere of influence of the City of Cypress as well as other affected governmental entities . SECTION 6 . That the City Council of the City of Cypress requests that dissolution proceedings be undertaken as proposed herein pursuant to Part 3 of the Cortese-Knox Local Government Reorganization Act of 1985 and the City Clerk is ordered to file a certified copy of this Resolution of Application with the Executive Officer of LAFCO. -2- 8 6 u SECTION 7 . That the City Council of the City of Cypress hereby requests the Local Agency Formation Commission to establish in their Resolution a date certain on which the dissolution of the Cypress County Water District shall occur in order to provide necessary and proper lead time for planning the transition and notice to impacted constituents of the District. SECTION 8. That the territory affected by this action is determined by the City of Cypress to be developed for the purposes of reallocating property tax revenues in accordance with the terms of the Master Property Tax Transfer Agreement. SECTION 9 . The City of Cypress has determined that all property tax revenues which would have accrued pursuant to Revenue and Taxation Code Sections 97 and 98 to the Cypress County Water District, had the District remained a separate governmental entity, should be reallocated to the City of Cypress commencing in the first fiscal year in which the jurisdictional change is effective for tax purposes as provided in Government Code Section 54902 . 1 . Two ( 2 ) of the areas are located in Los Angeles County and the remaining two ( 2 ) areas are located in Orange County. For further clarification, a map of the Cypress County Water District is attached ( Exhibit B) The boundaries of the two ( 2 ) Los Angeles County areas are described as follows: Los Angeles County Area #1: boarded by the Coyote Creek Channel to the west, City of Cypress/Orange County to the east, and Crescent Avenue to the south. Los Angeles County Area #2: boarded by the Coyote Creek Channel to the west and north, City of Cypress/Orange County to the east, and Woodson Street to the south. This area is referred to as the Van Ruiten Annexations. The boundaries of the two ( 2 ) Orange County areas are described as follows: Orange County Area #1: The boundaries of this area are identified as the same boundaries described in Annexation No. 88-1, City of Cypress, scheduled to become effective 9/1/88. Orange County Area #2: located in the City of Buena Park, boarded by the City of Cypress to the west, Lincoln Avenue to the north, Holder Street to the east, and the City of Cypress to the south.
