RESOLUTION NO. 3469
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, COUNTY OF ORANGE,
STATE OF CALIFORNIA, GIVING NOTICE OF AND APPOINTING A TIME AND PLACE FOR
HEARING PROTESTS IN RELATION TO THE PROPOSED IMPROVEMENT REFERRED TO IN
RESOLUTION OF INTENTION NO. 3468.
WHEREAS, the City Council of the City of Cypress, County of Orange,
State of California, did, in Resolution No. 3459 of said Council , adopted
October 24, 1988, pursuant to the provisions of Division 14, Part 1 , Streets
and Highways Code, State of California, as amended, hereinafter referred to as
the "Street Lighting Act of 1919" , require the City Engineer of said City to
make and file with the City Clerk of said City a written preliminary report
presenting certain matters relating to a proposed installation and maintenance
of a street lighting system, which system is Cypress Lighting District No. 2;
and,
WHEREAS, the City Engineer, pursuant to the requirements of said City
Council , expressed in Resolution No. 3459 and of said Street Lighting Act of
1919, did make and file in the office of the City Clerk of the City of
Cypress, California, his written preliminary report relating to the proposed
installation of a street lighting system in Cypress Lighting District No. 2;
and,
WHEREAS, said preliminary report includes the facts, figures, and
other necessary information relative to the territory covered by Annexation to
the City of Cypress No. 88-1 as directed by Resolution No. 3459 of the City
Council of the City of Cypress; and
WHEREAS, in conformity with Resolution No. 88-31 of the Local Agency
Formation Commission of the County of Orange and, pursuant to the provisions
of Sections 19210 through 19291 of the Streets and Highways Code of the State
of California, that territory covered by both Annexation to the City of
Cypress No. 88-1 and the. Orange County Street Lighting Assessment District
shall be withdrawn from said County Lighting District and made a part of
Cypress Lighting District No. 2; and
WHEREAS, the City Council of said City has proceeded to carefully
examine, inspect and consider said preliminary report, and has afforded all
persons interested an opportunity to be heard with reference thereto and is
satisfied with said preliminary report and with each and all the various items
thereof and the matters therein set forth; and,
WHEREAS, after the approval of said preliminary report, and in
conformity with the provisions of said Street Lighting Act of 1919, said City
Council did duly and regularly adopt Resolution of Intention No.3468 entitled,
"A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS, COUNTY OF ORANGE,
STATE OF CALIFORNIA, DECLARING ITS INTENTION TO ORDER A STREET LIGHTING SYSTEM
ON CERTAIN STREETS IN THE CITY OF CYPRESS, TO BE INSTALLED AND MAINTAINED AND
ELECTRIC CURRENT TO BE FURNISHED FOR LIGHTING SAID SYSTEM FOR A PERIOD OF ONE
( 1 ) YEAR BEGINNING JANUARY 1 , 1989, AND ENDING JANUARY 1 , 1990" ; and,
WHEREAS, it now becomes the duty of this Council to appoint a time
and place for hearing protests in relation to the proposed improvement
referred to in said Resolution of Intention No.3468 , and to direct the giving
of notice of said hearing.
NOW, THEREFORE, IT IS HEREBY RESOLVED, DECLARED, DETERMINED AND
ORDERED BY THE CITY COUNCIL OF THE CITY OF CYPRESS, COUNTY OF ORANGE, STATE OF
CALIFORNIA, AS FOLLOWS:
SECTION 1. That the 12th day of December 1988, at the hour of
7.30 p.m. of said day, be, and the same is hereby appointed as, the place for
hearing the proposed improvement.
SECTION 2. That. the City Clerk of the City of Cypress is hereby
authorized, designated and directed to give notice of said hearing in time,
form and manner as required by the Street Lighting Act of 1919.

SECTION 3. That said notice shall include reference to the
withdrawal of territory from the Orange County Street Lighting Assessment
District and inclusion of the same territory into Cypress Lighting District
No. 2. Said notice shall further provide that the date, time, and location
listed above is the time for all protests to the transfer of said territory in
addition to any other protests provided for by this Resolution.
SECTION 4. The City Council of the City of Cypress hereby
declares that there is no daily or weekly newspaper published and circulated
in the City of Cypress. The City Clerk of the City of Cypress is hereby
directed to post notice of said hearing for four days in three public places
in the City of Cypress, pursuant to Section 18013 of the Street Lighting Act
of 1919.
SECTION 5. That the City Clerk shall certify to the adoption of
this Resolution and the same shall thereupon take effect and be in force.
PASSED AND ADOPTED by the City Council of the City of Cypress , at a
regular meeting held on the 14th day of November, 1988.
