Resolution No. 953b RESOLUTION NO. 953 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS MAKING APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION OF ORANGE COUNTY FOR THE INITIATION OF PROCEEDINGS FOR THE DISSOLUTION OF THE CYPRESS COUNTY WATER DISTRICT. WHEREAS, the District Reorganization Act of 1965 provides that the govern- ing body of an affected city may make application by resolution for the dissolu- tion of a district, and that such application shall be considered a mandatory application; and WHEREAS, the City Council of the City of Cypress desires that proceedings be initiated by the Local Agency Formation Commission of Orange County for the dissolution of the Cypress County Water District, as hereinafter requested; NOW, THEREFORE, the City Council of the City of Cypress hereby does resolve, determine and find as follows: Section 1. This proposal is made pursuant to Division 1 of Title 6 of the Government Code of the State of California, known as "The District Reorganization Act of 1965." Section 2. The nature of the change of organization proposed hereby is a "dissolution "; and the name of the district for which such change of organization is proposed is "The Cypress County Water District." Section 3. The City Council of the City of Cypress desires the change of organization proposed hereby be made subject to the following proposed terms and conditions: A. That upon dissolution, the property of the Cypress County Water District, both real and personal, shall be distributed as pro- vided in the District Reorganization Act of 1965, except that real property located within that portion of the Cypress County Water District which is unincorporated territory also shall be distributed to the City of Cypress. B. That each affected City, after dissolution, shall provide for service to the areas within its boundaries which had previously received service from said District; and that the City of Cypress shall also serve those areas within unincorporated territory which had previously received service from said District; and that the City of Cypress shall enter into contracts, joint powers agreements, or other arrangements as may be deemed necessary to continue the operation and maintenance of facilities within said unincorporated areas and said affected Cities for so long as other affected Cities and the County of Orange may be unable to provide such service. Section 4. The reason or reasons for this proposal are that the dissolution of the Cypress County Water District would be for the best interests of landowners and present and future inhabitants within said District based on, but not limited to, the following findings: A. The original purpose of the Cypress County Water District, which was to create a governmental entity with the power to provide sewer service to County unincorporated area which had no other means of obtaining this service, has been achieved. At the present time, there are other governmental agencies which are capable of providing the same sewer service to the area. B. Double taxation for sanitary sewer service would be eliminated by removing the Cypress County Water District tax which in 1968- 69 was 12Q per $100.00 assessed valuation for all residents of the City of Cypress now located within the boundaries of the Cypress County Water District. Currently all residents of the City of Cypress outside of the Cypress County Water District are provided the same sewer service by the City without the payment of any additional tax or other charges. RESOLUTION NO. 953 87 C. An estimated 50% reduction in the cost of sewer service to residents of the Cypress County Water District located outside of the City of Cypress could be realized by consolidating the sanitary sewer ser- vice and eliminating a major portion of the administrative and over- head costs now incurred. It is conservatively estimated that the annual savings through this consolidation would be in excess of $100,000.00. D. Property owners, residents and developers would realize additional savings by reducing the sewer construction plan check and inspection fee from 91% to 311%, eliminating the 6% fee now imposed by the Cypress County Water District. In the last twelve months, these savings would have been in the amount of $6,888.00. E. Sewer service should be administered by the agency which has the responsibility for approving and regulating subdivision and commer- cial and industrial developments of which sewers are an integral part. To avoid duplication of costs and inconvenience to the public and to coordinate the design and construction of.new or relocated sewers within the City streets, the responsibility for sewer service should be that of the agency which is responsible for the construction and maintenance of such City streets. F. The elimination of structures of government no longer needed both maximizes the economies which can be afforded to our citizens and removes the confusion which always exists for the citizen in deter- mining the agency responsible for providing local governmental services. WHEREFORE, the City Council of the City of Cypress respectfully requests that preliminary proceedings be taken for the change of organization proposed hereby.
