A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN
REAL PROPERTY IN THE COUNTY OF ORANGE, STATE OF CALIFORNIA
AND DECLARING THE PUBLIC NECESSITY THEREFOR.
WHEREAS, the City of Cypress is authorized by virtue of the Statutes of the
State of California, to take property by condemnation and hold, use and enjoy
said property as necessary to the full exercise of its power;
NOW, THEREFORE, the City Council of the City of Cypress does hereby resolve
as follows:
SECTION 1. That the City Council of the City of Cypress has found and deter-
mined and does hereby find and determine that the public interest and necessity
require for public use the acquisition, construction, completion, operation and
maintenance by said City of Cypress of certain public improvements, to wit:
A permanent right of way easement for storm drainage purposes and a temporary
construction easement, and that certain real property situated in the City of
Cypress, County of Orange, State of California is necessary therefor.
SECTION 2. That the real property, the acquisition of which is required for
the public interest and necessity for the uses and purposes set forth in Section 1
hereof, is situated in the City of Cypress, County of Orange, State of California,
and is more particularly described in Exhibit "A" attached hereto and by this
reference incorporated herein.
SECTION 3. Said public improvement is planned and located in a manner which
will be most compatible with the greatest public good and the least private injury.
SECTION 4. The firm of Rutan and Tucker, Attorneys for the City of Cypress,
is hereby directed to bring an action in the Superior Court of the State of Cali-
fornia, in and for the County of Orange, in the name of the City of Cypress, against
all owners and claimants of the property described in Exhibit "A" attached hereto
and previously incorporated herein for the purpose of condemning and acquiring
said property for the public use of said City of Cypress and to do all things
necessary to prosecute said action to its final determination in accordance with the
provisions of law applicable thereto. That said Attorneys are authorized and in-
structed to make application to said Court for an Order fixing the amount of
security by the way of money deposits as said Court may direct, and for an Order
permitting the City of Cypress to take possession and use of said real property
for the uses and purposes herein described.
SECTION 5. For the purpose of bringing such an action, the firm of Rutan
and Tucker, is hereby empowered to incur, in the name of the City of Cypress, all
obligations and expenses incidental thereto.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 10th day of March, 1969.

EXHIBIT "A"
A storm drain easement and a temporary construction easement on, across, over
or through the following described parcels:
PARCEL 1: (A storm drain easement) .
Being a portion of the southwest quarter of the northwest quarter of Section 16,
Township 4 South, Range 11 West, as shown on a map recorded in Book 51, page 11
of Miscellaneous Maps and also being a portion of Lots A and B of Tract No. 928
as said Lots are shown on a map recorded in Book 29, page 8 of Miscellaneous
Maps of said Orange County, and described as follows:
Beginning at the northwest corner of said Lot B, said corner being the northeast
corner of the West -half of the southwest quarter of the northwest quarter of said
Section 16; thence North 89 °35'21" East, 593.62 feet along the north lines of
said Lots A and B; thence South 0 °23'08" East, 23.50 feet; thence North 89 °35'21"
East, 50.00 feet to a point in the east line of said Lot A; thence South 0 °23'08"
East, 4.00 feet along said east line, said east line being the West right of way
line of Grindlay Street, thence South 89035'21" West, 140.00 feet; thence North
79 °06'03" West, 50.99 feet; thence South 89 °35'21" West, 453.63 feet to the West
line of said Lot B; thence North 0 °22'45" West, 17.54 feet to the point of begin-
ning.
PARCEL 2: (A temporary construction easement).
Being portions of Lots A, B and 12 of said Tract No. 928 described as follows:
All of Lot A, the northerly 77.50 feet of Lot B and the northerly 47.50 feet of
Lot 12, said easement to terminate one year from date of signature or six months
after date of recording, whichever occurs first.
