RESOLUTION NO. 984
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CYPRESS REGARDING TERMS AND CONDITIONS FOR
CONTINUATION OF SANITARY SEWER SERVICE UPON
DISSOLUTION OF THE CYPRESS COUNTY WATER DISTRICT.
WHEREAS, the City Council of the City of Cypress adopted Resolution No.
953 on March 10, 1969, making application to the Local Agency Formation Commis-
sion of Orange County for the initiation of proceedings for the dissolution of
the Cypress County Water District; and
WHEREAS, Section 3 thereof stated that the City of Cypress desired that
the dissolution of the district be made subject to certain terms and conditions;
and
WHEREAS, a hearing on this matter has been scheduled before the Local
Agency Formation Commission of Orange County on Wednesday, June 25, 1969; and
WHEREAS, the City Council of the City of Cypress desires that the Local
Agency Formation Commission be fully apprised, at the time of such hearing,
of its intentions with regard to the continuation of sanitary sewer service.
NOW, THEREFORE, the City Council of the City of Cypress hereby does
resolve, determine and find as follows:
Section 1. Cost of Service
The City Council of the City of Cypress, upon investigation,
has found that the costs of sewer service are as follows:
(a) The current annual cost of sanitary sewer service
by the Cypress County Water District, collected by
property taxes of that district, is $15.37 per unit
connection.
(b) The current annual cost of such service outside
of the boundaries of the city, if the district were
dissolved and such service provided by the city, would
be $2.98 per unit connection.
(c) Such service within the boundaries of the city,
if the district were dissolved and such service provided
by the city, could be provided without any service charge
or special tax, other than the continuation of any
improvement district taxes necessary to retire outstanding
improvement district bonds of the district.
Section 2. Provision for Continued Sewer Service
The City Council of the City of Cypress hereby proposes
that sanitary sewer service within the boundaries of the district be
provided, upon dissolution of the district, as follows:
(a) The City of Cypress will provide sanitary sewer
service within the boundaries of the city, without service
charge or special tax for such service, other than the
continuation of any improvement district taxes necessary
to retire outstanding improvement district bonds of the
district.
(b) Any other city or county that wishes to provide
such service to their respective territories within the
boundaries of the district, will do so.
(c) The City of Cypress will provide sanitary sewer
service outside of the boundaries of the city under contracts
with the other cities and counties within the boundaries
of the district, under the provisions of Government Code
Subsection 55330, et seq., upon the following terms:
1. The City of Cypress will provide all sanitary
sewer service within the former territory
of the district located within any such city
or county.
2. The City of Cypress will provide such sanitary
sewer service to the territory within such
city or county territory at cost.
3. Any such city or county subsequently may
determine that such service within its
boundaries should be provided by it; and
thereafter provide such service.
PASSED AND ADOPTED by the City Council of the City of Cypress, at a
regular meeting held on the 23rd day of June , 1969.
