Resolution No. 1002171 RESOLUTION NO. 1002 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING A MODIFICATION OF CONDITIONAL USE PERMIT NO. C -211 (HYATT DIE CAST CORPORATION) AS RECOMMENDED BY THE CYPRESS PLANNING COMMISSION. WHEREAS, at its regular meeting of March 11, 1968, the Cypress City Council denied an appeal of the Cypress Planning Commission's decision to approve Conditional Use Permit No. C -211 to allow the establishment of a die casting manufacturing establishment in an M -1 (Light Manufacturing) zone, and concurred in the Planning Commission's approval of the subject Conditional Use Permit, subject to the following conditions: 1. The following conditions shall be constructed within eighteen months after occupancy of the facility. A. A six foot (6') high concrete block wall shall be constructed along the west property line adjacent to that area zoned for residential purposes, subject to staff approval. B. An area ten feet from the exterior east, south, and west property lines of the property, adjacent to any residentially zoned property shall be landscaped and permanently maintained with fifteen (15) gallon trees. C. The driveways shall be resurfaced. 2. The following conditions shall be complied with upon occupancy of the facility: A. Sidewalks and street furniture in front of the property shall be constructed. B. Drainage easement across the rear of the subject property running from west to east to the existing 2 -A Channel located easterly of the subject property shall be provided by the owner of the property. C. All drainage fees shall be paid. D. All lights shall be directed onto the property and shall not bleed onto the adjoining residential property. E. No outside production activity, buzzer, or loud speaker shall be allowed between the hours of 10:00 p.m. and 7:00 a.m. for six (6) days per week. F. No outside production shall be allowed on Sunday. G. No sand casting or smelting shall be allowed. H. All outside storage and yard areas shall be kept in an orderly manner, with no stacks or material over six feet (6') in height. I. Noise buffers shall be constructed if needed. J. Three -sided slag bins shall be provided, as approved by the City staff. and, WHEREAS, as a result of complaints which were received from citizens who reside near the Hyatt Die Cast Plant regarding the noise levels, vibrations, lights bleeding into the homes, loudspeaker, trash and debris on the property and the conduct of outside activities on Sundays, the City Council in June of 1969 initiated proceedings for modification or revocation of, Conditional Use Permit No. C -211: and 17r- WHEREAS, following a Public Hearing at its meeting of July 24, 1969, the Cypress Planning Commission adopted Planning Commission Resolution No. 473 recommending to the City Council the modification of Conditional Use Permit No. C -211 subject to certain conditions; and WHEREAS, the City Council of the City of Cypress held a Public Hearing at its regular meeting of August 25, 1969 and at its adjourned regular meeting of August 26, 1969 in the City Council Chambers, 5275 Orange Avenue, Cypress, California, to consider the possible modification or revocation of Conditional Use Permit No. C -211; and WHEREAS, during the. Public Hearing, the City Council received testimony, docu- ments, reports and other evidence both in favor of and in opposition to the modifi- cation or revocation of Conditional Use Permit No. C -211: and WHEREAS, the City Council, following the closing of the Public Hearing, approved the recommendation of the Planning Commission for modification of Conditional Use Permit C -211 subject to the following conditions, in addition to the original conditions approved on March 11, 1968: 1. Any exhaust stacks on spray booths shall be elevated above the peak of the highest building adjacent to them. 2. No odorous materials that adversely affect the general area shall be used in any spraying operation. 3. The south building shall be used for storage and warehouse purposes only and this conversion shall be effected within 120 days after the approval of this modification. 4. No boat engines shall be run at the Pico Craft Corporation. 5. The automatic bell system and intercom system shall operate weekdays between the hours of 7 a.m. and 7 p.m. and shall be shut off on weekends. This does not apply to emergency systems. 6. Phase No. 1 of the Bolt, Beranek and Newman Sound Abatement Report shall be commenced at once and shall be completed within 60 days of the approval of this modification. 7. No vibrations shall be allowed at the property line within 60 days after the approval of this modification. The machines causing the vibration at the present time shall not be operated after 8 p.m. on weekends. 8. The original condition No. 1B, shall be amended to read as follows: An area 10 feet from the exterior property lines adjacent to any residentially -zoned property shall be landscaped and permanently maintained. The landscape plan shall be prepared by a licensed landscape architect and approved by the Planning Director and City Manager. The landscape program shall be implemented immediately. 9. All outside compressors shall be acoustically enclosed and shut down when not in use. 10. After Phase No. 1 of the Bolt, Beranek and Newman Report is completed, Myatt Die Cast Corporation shall employ the firm of Bolt, Beranek and Newman, or any other qualified sound consulting firm approved by the City Manager, to make additional sound tests to determine if the sound has reached the ordinance requirement of a low decimal reading. If not, then Phase No. 2 of the Bolt, Beranek and Newman Report shall commence immediately and both the report and construction shall be accomplished within 90 days. 11. If, after 180 days, the Hyatt Die Cast Corporation is still not in accord with the ordinance, a public hearing will be held to revoke or modify the conditional use permit. NOW, THEREFORE BE IT RESOLVED that Conditional Use Permit No. C -211 hereby is modified by the City Council with the conditions recommended by the Planning Commission and modified by the City Council. - 2- 176 PASSED AND ADOPTED by the City Council of the City of Cypress at an adjourned regular meeting held on the 26th day of August, 1969.
