Resolution No. 1031RESOLUTION NO. 1031 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING DETACHMENT OF CITY TERRITORY FROM THE CYPRESS COUNTY WATER DISTRICT UPON CERTAIN TERMS AND CONDITIONS. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY RESOLVES that it would support the detachment of all territory within the City of Cypress from the Cypress County Water District upon the terms and conditions stated in the proposed Resolution of such District attached hereto as Exhibit "A." WHEREAS, the territory described in the map and foal descrip tion attached hereto is presently within the boundaries of the Cypress County Water District and the City of Cypress; and WHEREAS, the City of Cypress is willing.and able to provide sewer maintenance service to all areas within its boundaries; NOW, THEREFORE, in consideration of the foregoing, the Board of Directors of the CYPRESS COUNTY WATER DISTRICT, of Orange County, California, does hereby RESOLVE as follows: 1. That this Resolution of Application is filed pursuant to the pro- visions of Division 1 of Title 6 of the Government Code of the State of Cali- fornia for the purposes of proposing the detachment of territory from the Cypress County Water District, of Orange County, California. 2. That the boundaries of the territory to be detached are described in the map and legal description attached hereto. 3. That the territory proposed to be detached is inhabited and is entirely located within the County of Orange, California. 4. That the names of the affected districts and cities are as follows: City of Cypress; City of Buena Park; City of Anaheim; City of La Palma; City of Hawaiian Gardens; County Library District; Orange County Flood Control District; Orange County Harbor District; Orange County Mosquito Abatement District; Cypress Recreation, and Park District; Orange County Municipal Water District; Orange County Sanitation District #3; Grange County Water District; Orange County Water District Water Reserve; Los Alamitos County Water District; Cypress County Water District Los Alamitos Highway Lighting District; Stanton County Water District; Midway City Sanitary District; Magnolia Memorial Park Cemetery District; Cypress Lighting District. - • 5. That the reason for the proposed detachment is to relieve the 2 H territory to be detached from double taxation. 6. That the Board of Directors of the Cypress County Water Dis- trict respectfully requests the Local Agency Forrnation Commission of Orange 5 County, California, to institute proceedings for the detachment of said terr^:.- $ tory from the District. `1 7. That the Cypress County Water District be designated as the 8 conducting district for said proceedings and that the Board of Directors 9 thereof be directed to initiate the appropriate detachment proceedings. 10 8. FORMA 112701 mission determine that no election shall be called unless required by the pro- visions of Government Code Section 56320 and that any election so called shall be held only within the territory to be detached. 9. It is further requested that said detachment be approved subject to the following conditions: (a) That the territory to be detached be relieved from liability for payment of all or any part of principal, interest and any other amounts which may become due on account of all or any part of any bonded indebtedness or other contracts or obligations, including but not limited to any judgments, of the Cypress County Water Dis- trict and shall be relieved from the levying or fixing and the collection of any taxes or assessments as may be made for the payment thereof; (b) That all sewer facilities, easements and other real property of the Cypress County Water District located within the *territory to be detached shall vest in the City of Cypress; (c) That the City of Cypress shall pay to the Cypress County Water District a sum equal to 33. 65% of the current appraised value of the District's office building and the property upon which it is situated located at the northwest corner of Orange Avenue and \Maine Street in the City of Cypress. ATTEST: 0, 029. 91 (67. 35% of the current unap propr= ated reserve of.`'$16, 377.00); (ii) All taxes collected by the District from lands located within the City of Cypress during the fiscal year 1970 -71; (d) That such amount be paid-no later than January 1, 1972, and that title to such land and building located thereon shall not vest in the City .until such payment is made in full. The current appraised value of said office building and land shall be determined by the appraisal of any practicing M. A.I. Appraiser in the County of Orange; the cost of such appraisal to be borne equally by the City and the District; (e) The District shall remain in possession of said land and office building until January 1, 1971, or until such earlier date as the City shall make other alternate adequate facilities available for use by the District; (f) In the event any portion of the District hereafter is annexed to the City of Cypress, such portion shall concurrently be detached from the District.
