Resolution No. 1065RESOLUTION NO. 1055 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS AUTHORIZING AND DIRECTING TIE CONDEMNATION OF CERTAIN REAL PROPERTY IN THE COUNTY OF ORANGE, STATE OF CALIFORNIA AND DECLARING THE PUBLIC NECESSITY THEREFOR. WHEREAS, the City of Cypress is authorised by virtue of the Statutes of the State of California, to take property by condemnation and hold, use and enjoy said property as necessary to the full exercise of its power; NOW, THEREFORE, the City Council of the City of Cypress does hereby resolve as follows: SECTION 1. That the City Council of the City of Cypress has found and determined and does hereby find and determine that the public interest and necessity require for public use the acquisition, construction, completion, operation and maintenance by said City of Cypress of certain public improvements, to wit: An easement for street and public utilities right of way purposes, and that certain real property situated in the City of Cypress, County of Orange, State of California is necessary therefore. SECTION 2. That the real property, the acquisition of which is required for the public interest and necessity for the uses and purposes set forth in Section 1 hereof, is situated in the City of Cypress, County of Orange, State of California, and is more particularly described as follows, to wit: Being a portion of the southwest quarter of Section 15, Township 4 South, Range 11 West, in the Rancho Los Coyotes, per trap recorded in Book 51 at page 11 of Miscellaneous Maps, in the office of the County Recorder of said Orange County: PARCEL 1: The east 42.00 feet of the south 200 feet of the said southwest quarter; PARCEL 2: A corner cutoff described as follows: Beginning at the Southeast corner of said Southwest quarter thence Westerly along the Southerly lime of said Section 13 to a point in • line which is parallel with the 42' Westerly of the center line of Holder Street, thence Northerly along said line to a point in a line which is parallel with and Northerly 50' from the Southerly line of said Section 15 to the true point of beginning; thence Northerly along said line parallel with the center line of Holder Street 15', thence Southwesterly in a direct line to a point in said line parallel to the Southerly line of said Section 15 and 15' Westerly from the true point of beginning, thence 15' Easterly to the true point of beginning. SECTION 3. Said public improvement is planned and located in a manner which will be most compatible with the greatest public good and the least private injury. SECTION 4. The firm of Buten and Tucker, attorneys for the City of Cypress, is hereby directed to bring an action in the Superior Court of the State of Calif- orals, in and for the County of Orange, in the name of the City of Cypress, to condemn by eminent domain proceedings the property described in Section 2 hereof for the purpose of condsmnisg and acquiring said property for the public use of the City of Cypress and to do all things necessary to prosecute said action to its final determination in accordance with the provisions of law applicable thereto. That said attorneys are authorised and instructed to make application to said Court for an Order fixing the amount of security by the way of money deposits as said Court may direct and for an Order permitting the City of Cypress to take possession and use of said real property for the uses and purposes herein described. SECTION 5, For the purposes of bringing such an action, the firm of Rutan and Tucker, is hereby empowered to incur, in the name of the City of Cypress, all obligations and expenses incidental thereto.
