A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN
REAL PROPERTY IN THE COUNT! OF ORANGE, STATE OF CALI-
FORNIA AND DECLARING THE PUBLIC NECESSITY THEREFOR.
WHEREAS, the City of Cypress is authorised by virtue of the Statutes of the
State of California, to take property by condemnation and hold, use and enjoy
said property as necessary to the full exercise of its power;
NOW, THEREFORE, the City Council of the City of Cypress does hereby resolve
as follows:
SECTION 1. That the City Council of the City of Cypress has found and deter-
mined and does hereby find and determine that the public interest and necessity
require for public use the acquisition, construction, completion, operation and
maintenance by said City of Cypress of certain public improvements, to wit:
An easement for street and public utilities right of way purposes,
and that certain real property situated in the City of Cypress,
County of Orange, State of California is necessary therefor.
SECTION 2. That the real property, the acquisition of which is required for
the public interest and necessity for the uses and purposes set forth in Section
1 hereof, is situated in the City of Cypress, County of Orange, State of California,
and is more particularly described as follows, to wit:
PARCEL 1: The westerly ten (10.00) feet of the easterly forty -two
(42.00) feat of the southerly two hundred (200.00) feet
of the southwest quarter of Section 15, Township 4 South,
Range 11 West, excepting the southerly sixty -five (65.00)
feet thereof, and
PARCEL 2: A corner cut -off being a portion of the said southwest
quarter of said Section 15 and described as follows:
Beginning at the southeast corner of the said southwest
quarter, thence westerly along the south line of said
southwest quarter to a point in a line parallel with
and distant 47.00 feet westerly of the east line of
said southwest quarter, thence northerly along said
parallel line to a point in a line parallel with and
distant 50.00 feet northerly of the south line of said
southwest quarter, said point being the point of beginning;
thence westerly along last named parallel line 10.00 feet;
thence northeasterly to the point of intersection of the
west line of the east 42.00 feet and north line of the
south 65.00 feet of said southwest corner; thence easterly
along said north line 10.00 feet to the west line of the
east 32.00 feet of said southwest quarter; thence south-
westerly to the point of beginning.
SECTION 3. Said public improvement is planned and located in a manner which
will be most compatible with the greatest public good and the least private injury.
SECTION 4. The first of Rutan and Tucker, attorneys for the City of Cypress
is hereby directed to bring an action in the Superior Court of the State of Cali -
fornia, in and for the County of Orange, in the name of the City of Cypress, to
condemn by eminent domain proceedings the property described in Section 2 hereof
for the purpose of condemtning and acquiring said property for the public use
of the City of Cypress and to do all things necessary to prosecute said action to
its final determination in accordance with the provisions of law applicable thereto.
That said attorneys are authorized and instructed to make application to said
Court for an Order fixing the amount of security by the way of money deposit as
said Court may direct and for an Order permitting the City of Cypress to take
possession and use of said real property for the uses and purposes herein described.

SECTION 5. For the purposes of bringing such an action, the firm of Rutan
and Tucker, is hereby empowered to incur, in the name of the City of Cypress, all
obligations and expenses incidental thereto.
PASSED AND ADOPTED by the City Council of the City of Cypress at a regular
meeting held on the 10th day of August, 1970.
