Resolution No. 1100366 RESOLUTION NO. 1100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS CALLING A SPECIAL ELECTI01i AND SUBMITTING TO THE ELECTORS RESIDING IN THE TERRITORY CONTAINED WITHIN THE BOUNDARIES OF ANNEXATION NO. 61-6 mi QUESTION WHETHER SAID TERRITORY SHALL BE ANNEXED TO AID INCORPORATED WITHIN THE CITY OF CYPRESS. WHEREAS, proceedings ware duly initiated as required by law for the annexation of certain inhabited territory in the City of Cypress designated as Annexation No. 69 -6, in accordance with the Annexation Act of 1913; and WHEREAS, a hearing was held by the City Council of the City of Cypress to hear and receive protests to the proposed annexation; and WHEREAS, the City Council of the City of Cypress did find and declare by Resolution No. 1096, passed and adopted on the 10th day of August, 1970, within 30 days after the closing of the hearing on said protests, that a majority protest had not been made to Annexation No. 69 -6; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cypress as follows: SECTION 1. There is hereby called a special election to be held on the 20th day of October, 1970, which is not sooner than 54 days and not later than 75 days after the termination of the hearing on protests or supplemental protests. SECTION 2. The boundaries of said territory are described as follows: A parcel of land situated in the County of Orange, State of California, and being a portion of Sections 8, 9, 16 and 17, Township 4 South, Range 11 West in the Rancho Los Coyotes, as said Sections are shown on a map recorded in Book 51, page 11 of Miscellaneous Maps in the office of the County Recorder of said Orange County; BEGINNING at the northwest corner of the southeast quarter of the southeast quarter of said Section 8, said corner being the northwest corner of Tract No. 3532 as shown on a map recorded in Book 127 at pages 26 thru 28 of Miscellaneous Maps of said County Recorder and said corner being a point in the current cor- porate boundary of the City of Cypress as defined by the Lincoln Annexation, Ordinance No. 163; THENCE, North 89° 33' 15" East, 675.01 feet, departing from the said cor- porate boundary, along the north boundary of said Tract to a northeast corner of said Tract; THENCE, South 0° 10' 13" East, 674.26 feet, along an east boundary of said Tract, also said east boundary being a west boundary of Tract No. 527 as shown on a map recorded in Book 18, page 9 of Miscellaneous Maps of said County Re- corder, to a southwest corner of said Tract No. 527; THENCE, North 89° 48' 17" East, 677.54 feet along the most southerly boundary of said Tract No 527 to the southeast corner of said Tract, said Southeast corner being a point in the east line of said Section 8; THENCE, South 0° 23' 15" East, 328.58 feet along the said east line of Section 8, said east line being the vest boundary of Tract No. 3618 as shown on a map recorded in Book 131, pima 1 thru 3 of Miscellaneous Maps of said County Recorder, and said west boundary being the centerline of Moody Street, to the southwest corner of said Tract No. 3618; THENCE, North 89° 47' 55" East, 50.00 feet along the south boundary of said Tract No. 3618 to the east right of way line of said Moody Street, said point being an angle point in the corporate boundary of the City of Cypress as defined.by Annexation 67 -3, Ordinance No. 366, and along the said Annexation No. 67 -3 the following six courses; THENCE, South 0° 23' 15" East, 330.00 feet along said east right of way line, said east line being the east line of the west 50.00 feet of said Section 9, to the south line of said Section 9; THENCE, South 0° 22' 23" East, 50.00 feet along the east line of the west 50.00 feet of said Section 16, to intersect a southerly right of way line of Lincoln Avenue; THENCE, South 44° 42' 32" West, 1412 feet along said southerly right of way line to intersect the east right of way line of Moody Street, said right of way being the east line of the west 40.00 feet of said Section 16; THENCE, South 00 22' 23" East, 115.00 feet along said east line to an angle point in the said east right of way line; THENCE, South 890 47' 27" West, 10.00 feet, to the east line of the west 30.00 feet of said Section 16; THENCE, South 0° 22' 23" East 508.11 feet along said east line to the south line of the north -half of the northwest quarter of the northwest quarter of said Section 16, said South line being a point in the said corporate boundary as defined by the Schipper Annexation, Ordinance No. 35 and along the said Schipper Annexation the following five courses; THENCE, South 89° 41' 30" West 130.00 feet along said south line to the west line of said Section 16; THENCE, South 89° 38' 38" West, 30.00 feet along the south line of the north -half of the northeast quarter of the northeast quarter of said Section 17, to the West line of the east 30.00 feet of said Section 17, said West line being the west right of way line of Moody Street; THENCE, North 00 22' 23" West, 11.66 feet along the said west line of Moody Street to intersect the south right of way line of Camp Street, said south line being 10.00 feet southerly of, as measured perpendicular, the centerline of said Camp Street. THENCE, South 89° 38' 38" West 694.16 feet along said south line to inter- sect the east line of the West 5.0 acres of the north -half of the south -half of the northeast quarter of the northeast quarter of said Section 17; THENCE, South 00 22' 23" East, 11.66 feet along said east line to inter- sect the south line of the north -half of the northeast quarter of the north- east quarter of said Section 17; THENCE, South 890 41' 35" West, 635.96 feet, along said south line and along the corporate boundary as defined by the Hoffman Annexation, Ordinance No. 261, to the west line of the northeast quarter of the northeast quarter of said Section 17; THENCE, North 0° 22' 25" West, 285.53 feet along said West line and along the corporate boundary as defined by the Buell Annexation, Ordinance No. 132 to the south line of the north 400 feet of the northeast quarter of the north- east quarter of said Section 17, and along the said Buell Annexation the following 3 courses: THENCE, North 89° 47' 30" East, 65.00 feet along said south line to the east line of the West 65.00 feet of the northeast quarter of the northeast quarter of said Section 17; THENCE, North 0° 22' 25" West, 46600 feet along said east line and the northerly prolongation thereof, to the north line of the south 66.00 feet of said Section 8, said north line being the north right of way line of said Lincoln Avenue; THENCE, South 89° 47' 30" West, 65.00 feet, along said north line to the east line of the west -half of the southeast quarter of said Section 8; said east line being the west boundary of aforesaid Tract No. 3532; THENCE, North 0° 02' 53" East, 1264.00 feet, along said West boundary and along the corporate boundary as defined by the Lincoln Annexation, Ordi- - 2 - nanc 34; 163, to the northwest corner of said Tract, said corner being the point of beginning. Containing 52.37 acres of land,more or less. SECTION 3. The proposition to be submitted to said electors shall be stated on the ballots as follows: "Shall Annexation No. 69 -6 be annexed to the City of Cypress ?" SECTION 4. The inhabited territory described herein, which is proposed to be annexed, shall be designated upon the election ballots as "Annexation No. 69 -6" which was the same designation given to said territory in the reso- lution of intention to call a special election, being Resolution No. 1063 of the City Council of the City of Cypress. SECTION 5. Opposite the statement of the proposition on the ballots shall be printed the words "YES" and "NO" with a voting square to the right of each. Electors shall stamp a cross in one of these two voting squares, and if an elector stamps a cross in the voting square after the word "YES ", his vote shall be counted for the annexation, and if he stamps a cross in the voting square after the word "NO ", his vote shall be counted against annexation. SECTION 6. The voting precincts and the places at which voting polls will be open for the election shall be those for voting within said territory, and hereby are established and designated as follows: PRECINCT ADDRESS 1 4861 Lincoln (Recreation Hall) SECTION 7. The following are hereby appointed as officers of this special elections each being a qualified voter of the voting precinct in which he is appointed to act: A. Precinct No. 1 Inspector - Jean M. Smith, 8792 Belmont Judge - Florence Sheets, 4802 Merten Clerk - Virginia L. Evans, 4802 Alaska Clerk - Peggy J. Manna, 4822 Merten SECTION 8. The City Clerk of the City of Cypress is authorized and in- structed to publish notice of this election at least once a week for the four weeks prior to the 19th day of October, 1970, in the News Enterprise-, a news- paper of general circulation printed and published outside the City of Cypress, but within the County of Orange.
