HomeMy WebLinkAboutResolution No. 320434 RESOLUTION NO. 3204 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS APPROVING CERTAIN PROCEDURES RELATIVE TO RECENT AMENDMENTS TO THE RALPH M. BROWN ACT /PUBLIC MEETING LAW. WHEREAS, meetings of the City Council of the City of Cypress are subject to the Ralph M. Brown Act /Public Meeting Law, as set forth in Government Code 054950, et seq. (the "Brown Act "); and WHEREAS, amendments to the Brown Act enacted pursuant to Chapter 641, 1986 Statutes, became effective January 1, 1987; and WHEREAS, the City Council desires at this time to formally approve certain procedural rules to assist in the application of the Brown Act as so amended. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CYPRESS DOES RESOLVE AS FOLLOWS: 1. The City Council approves the procedures set forth in Exhibit "A ", which are attached hereto and incorporated by reference. 2. The foregoing procedures shall be subject to review and such modification as the City Council may deem appropriate. Agendas for all meetings shall be posted outside bulletin board, Cypress City Ha11,5275 Orange Avenue,Cypress. A copy of each agenda additionally is to be available for public inspection at the Cypress Police Department (front desk). 2. The City Clerk is to routinely report at each meeting (verbally or in writing) as to the time and place the agenda for such meeting was posted. 3. An item or items may be placed on the agenda for any regular meeting by (a) any member of the City Council or (b) the city Manager, so long as the item is sought to be added in sufficient time that the 72 -hour posting requirement of the Brown Act may be satisfied. 4. Every agenda for a regular meeting shall include an item of "Oral Communications ", during which members of the public shall have an opportunity to address the City Council. The time allotted for each speaker shall be a maximum of FIVE MINUTES, and the total amount of the time allotted for oral communications (including comments by member of the public and discussion, if any, of member of the public with members of the City Council) shall not exceed ONE HOUR per meeting; provided that the foregoing time limits may be extended by majority vote of the City Council members present at the meeting. Every agenda shall include an item for the taking of action to extend time, to allow for the option of the extension of time (or declining to extend time) as the City Council may deem appropriate. 5. Where a request to take action arises from public comment concerning an item not on the agenda, the matter shall be deemed received and filed and shall automatically and without necessity of specific action thereon be deemed referred to staff for review and, unless otherwise indicated by the member of the public or the City Manager, shall be placed on the agenda for the succeeding regular meeting; no action shall be taken at the meeting at which the item is first addressed as a non- agenda item. Alternatively, the City Council may set the matter for consideration at a specified meeting, without reaching at the time the non - agenda item is set for consideration at a subsequent meeting, a collective consensus as to what action, if any, shall be taken at such later meeting. Notwithstanding the foregoing, action may be taken on an item not on the agenda in the following circumstances: (a) where the City Council approves by majority vote determinations that an "emergency situation" exists (which shall be a work stoppage or other activity which severely impairs public health, safety or both, or a crippling disaster which severely impairs public health, safety, or both) and that prompt action is required; and (b) where the City Council by two - thirds vote (or by unanimous vote if less than two - thirds but more than a quorum of its members are present) finds that the need to take action on the non - agenda item is required because the need to act arise after the posting of the agenda.
