RESOLUTION NO. 3207
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
APPROVING AMENDMENT TO CONDITIONAL USE PERMIT NO. 85 -15 -
WITH CONDITIONS.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES,
DETERMINES, AND ORDERS AS FOLLOWS:
1. That an application was filed for a conditional use permit in
accordance with the provisions of Section 17.2 of the Zoning Ordinance of
the City of Cypress to reconsider a condition of approval prohibiting the
placement of a 5,000- gallon liquid nitrogen storage tank at the rear of the
property located at 6297 Ball Road.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council hereby finds that:
a. The proposed location of the amendment to conditional use
is in accord with the objectives of the Zoning Ordinance and the
purpose of the zone in which the site is located is:
Intended as an area for the location of retail and
wholesale commercial activities.
b. The proposed location of the amendment to conditional use
and the conditions under which it would be operated or maintained
will not be detrimental to the public health, safety or welfare
or be materially injurious to properties or improvements in the
vicinity in that:
(1) Liquid nitrogen is far less hazardous than other
commonly used refrigerants such as freon and
chlorinated fluorocarbons.
(2) Nitrogen is a nonflammable and nonexplosive gas.
(3) Safety features are incorporated into the design of
of the tank.
(4) The placement and construction of the tank shall
meet all requirements of the Uniform Fire Code,
Article 75.
(5) The applicant shall obtain all necessary permits
required for the storage, handling or transporting
of liquid nitrogen prior to placement of the
storage vessel. The applicant shall contact
Captain Ralph Titus of the Orange County Fire
Prevention Bureau, phone (714) 821 -7850 or
(213) 431 -5193, for further information.
(6) The gates providing access to the rear of the
property shall remain locked at all times except
for shipping and receiving.
(7) The liquid nitrogen tank shall be protected by
concrete crash posts approved by the Traffic
Engineer.
c. The proposed conditional use will comply with each of the
applicable provisions of the Zoning Ordinance except for approved
variances or adjustments.
4. The City Council DOES HEREBY GRANT said amendment to conditional
use permit, subject to the conditions attached hereto as Exhibit "A."
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 9th day of March 1987.

AMENDMENT TO CONDITIONAL USE PERMIT NO. 85 -15
ADDITIONAL CONDITIONS OF APPROVAL
1. The placement and construction of the 5,000 - gallon liquid nitrogen
storage tank shall comply with all requirements of the Uniform
Fire Code, Article 75.
2. The applicant shall obtain all necessary permits required for the
storage, handling or transporting of liquid nitrogen prior to place-
ment of the storage vessel. The applicant shall contact Captain
Ralph Titus of the Orange County Fire Prevention Bureau, phone
(714) 821 -7850 or (213) 431 -5193, for further information.
