HomeMy WebLinkAboutResolution No. 3224RESOLUTION NO. 3224 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS GRANTING A VARIANCE FROM THE TERMS OF THE ZONING ORDINANCE OF THE CITY OF CYPRESS TO ALLOW A 16 PERCENT INCREASE IN THE MAXIMUM ALLOWABLE LOT COVERAGE. VARIANCE NO. 87 -2 THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETERMINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a variance from the terms of the Zoning Ordinance of the City of Cypress to allow a 16 percent increase in the maximum allowable lot coverage as part of a two -story residential room addition at 5703 Lakia Drive. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council hereby finds that: a. Strict or literal interpretation and enforcement of the specified regulations would result in practical diffi- culty or unnecessary physical hardship in that the subject parcel is smaller and narrower than the standard lot size for the City. b. There are exceptional or extraordinary circumstances or conditions applicable to the property involved because of the reduced size of the subject property. c. Strict or literal interpretation and enforcement of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same zone. d. Due to the reduced size of the parcel, this variance will not constitute the granting of a special privilege. e. The granting of the variance will not be detrimental to the public health, safety, welfare, or materially injurious to properties or improvements in the vicinity because it will meet all building code safety require- ments and it will be reviewed for aesthetic compati- bility with surrounding properties under the Cypress design review process. 4. The City Council DOES HEREBY GRANT said variance subject to the con- ditions attached hereto as Exhibit "A." The applicant /developer shall comply with all provisions of the City Code. ?• Architectural elevations and site plans shall be reviewed and approved by the Pilinning Department prior to Building Department plan check submittal. The addition shall he constructed to match the existing architecture of the structure. 3. Second floor windows facing abutting single- family dwellings not required for building and /or fire codes shall be located a minimum of 56 inches from the floor. Second fluor windows facing abutting single- family dwellings which are required for fire and building safety shall utilize translucent glass to the satisfaction of the Planning Director. 4. The proposed buildings shall be constructed with the appropriate "sound insulation" material as required by the California Noise Insulation standards to mitigate the noise impact from the Los Alamitos Army Airfield. 5. All architectural treatments shall be constructed as illustrated on plans and renderings submitted. The final exterior color scheme shall be sub- mitted to City staff for review and approval prior to actually painting the structure. 6. Balconies and second -story decks shall not exceed six feet (6') in width with one dimension. 7. Prior to the issuance of building permits for any habitable building proposed for construction within the 60 CNEL contour from the Los Alamitos Army Airfield, the project proponent shall submit to the City of Cypress an acoustical analysis report. The report shall describe the acoustical design features of the structures required to satisfy the Airport Environs Land Use Plan and State interior noise standards along with evidence that the sound attenuation measures specified in the report have been incorpo- rated with the design of the project.
