HomeMy WebLinkAboutResolution No. 323489 RESOLUTION NO. 3234 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS DENYING VARIANCE NO. 87 -3. THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETER- MINES, AND ORDERS AS FOLLOWS: 1. That an application was filed for a variance from the terms of the Zoning Ordinance of the City of Cypress to permit an increase in the allow- able density and a decrease in parking requirements at 5701 Vonnie Lane. 2. That the City Council, after proper notice thereof, duly held a public hearing on said application as provided by law. 3. That the City Council does hereby DENY said variance because the following findings required by Section 17.3 -7 of the City of Cypress Zoning Ordinance cannot be made: a. That there are exceptional or extraordinary circum- stances or conditions applicable to the property involved which do not apply generally to other properties in the same zone. (1) This finding cannot be made because the subject property is not of an unusual size, shape or topography or is not affected by surrounding properties so as to create exceptional or extraordinary circumstances or conditions. b. That strict or literal interpretation and enforce- ment of the specified regulation would deprive the applicant of privileges enjoyed by the owners of other properties in the same zone. (1) This finding cannot be made because there are no other owners of property in the same zone which have received approval from the City to exceed the allowable density. c. That the granting of the variance as conditioned will not constitute the granting of a special privilege inconsistent with the limitations on other properties in the vicinity classified in the same zone. (1) This finding cannot be made because the grant- ing of this variance to increase density would constitute a special privilege inconsistent with the limitations on other properties in the vicinity classified in the same zone. 4. That the City Council further cannot make the following findings of Section 17.3 -9 of the City of Cypress Zoning Ordinance: a. That neither present nor anticipated future traffic volumes generated by the use of the site or uses of sites in the vicinity reasonably require strict or literal interpretation and enforcement of the speci- fied regulation. (1) This finding cannot be made because the proposed residential development would generate more traffic volumes than the project site could accommodate. b That the granting of the variance will not result in the parking or loading of vehicles on public streets in such a manner as to interfere with the free flow of traffic on the streets. (1) This finding cannot be made because the proposed reduction in onsite parking would create more demand for on- street parking in an area already overburdened with the loading of vehicles on public streets. 90 PASSED AND ADOPTED by the City Council of the City of Cypress at a regular meeting held on the 27th day of April 1987.
