RESOLUTION NO. 3247
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CYPRESS
DENYING GENERAL PLAN AMENDMENT NO. 86 -3 AND
ZONE CHANGE NO. 86 -3 WITHOUT PREJUDICE.
THE CITY COUNCIL OF THE CITY OF CYPRESS HEREBY FINDS, RESOLVES, DETER-
MINES AND ORDERS AS FOLLOWS:
1. That an application was filed for an Amendment to the Land Use Ele-
ment of the Cypress General Plan and the Zoning Ordinance of the City of
Cypress affecting a parcel of land located at 6242 Lincoln Avenue. The
amendments would change the General Plan designation of the subject parcel
from Commercial Heavy to High Density Residential and the zone from CH Com-
mercial Heavy to RM -20 /A Residential Multiple - Family.
2. That the City Council, after proper notice thereof, duly held a
public hearing on said application as provided by law.
3. That the City Council considered evidence presented at the public
hearing including a report prepared by the Planning staff.
4. That the City Council does hereby DENY WITHOUT PREJUDICE said Amend-
ment to the General Plan and Zone Change because of the following findings:
a. The intended use of the subject property as evidenced
by the existing General Plan and zoning designations
is commercial. The property is located within the LC
Lincoln Avenue Combining Zone which expands oppor-
tunities for the development of identified deep lots by
providing a means for the establishment of a variety
of urban uses in conjunction with commercial projects.
b. That there is a need to consider the zoning of the
subject property in conjunction with that of adjacent
properties. The establishment of a zone on the subject
property which is inconsistent with that of surrounding
properties may preclude efficient utilization of
property in the area.
c. The City Council has undertaken a study of Lincoln
Avenue with the intention of preparing a master plan
to guide development of that portion of the City.
Granting of the proposed amendments would preempt
alternatives for Lincoln Avenue. Denial without
prejudice of the subject application would allow the
application to be refiled and considered at a later
date, if appropriate.
4. The applicant may refile the subject application without charge once
a study of Lincoln Avenue is completed by the City Council.
PASSED AND ADOPTED by the City Council of the City of Cypress at a
regular meeting held on the 26th day of May 1987.
